We’ve included annotations in the gray boxes below to emphasize certain portions of our notice and help guide you as you read them. Annotations aren’t part of the terms and have no legal effect, but they should help you follow the text.
This page explains our terms for the Cashex service. By using the Service, you agree to these terms. If you use the Service on behalf of your company, your company agrees to them too.
These Cashex Terms of Service (the “Cashex Terms”) are a legal agreement between you, as a current or prospective user of the Services, and Cashex Global Inc. (hereafter, “the Company,” “we,” “our” or “us”), and governs your use of Cashex, a financial platform, which includes mobile applications, websites, software, cloud-based solutions, and other products and services (the “Service”) offered by the Company. If you are using the Service on behalf of a business or entity, you acknowledge and agree that you have authority to bind such business or entity and that such business or entity accepts these Terms. By using the Service you agree to be bound by these Cashex Terms and any policies referenced within (“Policies”), including our Privacy Notice (see Section V.5) and Cashex Acceptable Use Policy (see Section XIII.4).
Please review all Cashex Terms carefully, including those provisions which limit our liability (see Section XX.16) and those regarding individual arbitration for potential legal disputes (see Sections XX.18 and XX.19).

Transfer Out
Withdraw (standard) No fee to transfer money from your Cashex account to a linked account with the standard option. The money is typically available in 1–3 business days.
Instant Transfer Fee for expedited transfer from your Cashex account to a linked account. Funds are typically available within minutes. The applicable fee amount is disclosed at the time of the transaction.
ATM withdrawal – in-network Our ATM withdrawal fee is $2.50. If you receive $300 or more in paycheck direct deposits each month, we will waive our withdrawal fee until the end of the following calendar month.
ATM withdrawal – out-of-network Our ATM withdrawal fee is $2.50. You may also be charged a fee by the ATM operator. If you receive $300 or more in paycheck direct deposits in any given month, we will fully reimburse fees for one ATM withdrawal until the end of the following calendar month. Any additional withdrawals during that period will be $2.50, plus any operator fees.

No overdraft/credit feature.
If you have a Cashex “Sponsored Account” or a Cashex Card (when available in the future), your stored balances are eligible for FDIC pass-through insurance through our Program Banks (Wells Fargo Bank, N.A. and/or Sutton Bank, Members FDIC) for up to $250,000 per customer when aggregated with all other deposits held in the same legal capacity at each Program Bank, if certain conditions are met.
If you don’t have a Cashex Card, a Sponsored Account, or sponsor an account, your Cashex and savings balances are not deposit products and therefore are not protected by FDIC pass-through insurance. Cashex is a financial services platform, and not an FDIC-insured bank.

Minimum Age Requirement: You must be at least 16 years old to open a Cashex Account.
II. Revisions, Disclosures, and Notices
We can make updates to the Terms at any time, and we’ll notify you of these updates as appropriate. By continuing to use our Services after these updates, you agree to the revised terms.
You also agree to receive notices from us electronically.
Amendments to Cashex Terms. We may amend these Cashex Terms at any time with notice that we deem reasonable under the circumstances, by posting the revised version on our website, or by communicating it to you through the Services (each a “Revised Version”). Your continued use of the Services after the posting of a Revised Version constitutes your acceptance of such Revised Version. Any Dispute (as defined in Section XX.18) that arose before the changes will be governed by the Cashex Terms in place when the Dispute arose.
Electronic Disclosures and Notices. You agree to Cashex’s E-Sign Consent. We may provide disclosures and notices required by law and other information about your Account (defined below) to you electronically, at any time of day, including by posting it on our website, pushing notifications through the Services, or by emailing it to the email address listed in your Account. Electronic disclosures and notices have the same meaning and effect as if we had provided you with paper copies. Such disclosures and notices are considered received by you within twenty-four (24) hours of the time posted to our website, or within twenty-four (24) hours of the time pushed or emailed to you. If you wish to withdraw your consent to receiving electronic communications, contact Cashex Support. If we are not able to support your request, you may need to terminate your Account.
III. Cashex Account
1. Eligibility and Account Registration
Minimum Age & Residency. You must be at least 16 years old and a resident of the United States to register for a Cashex Account (“Account”). If you are using the Service on behalf of a business or legal entity, you must have authority to bind that entity. Certain features of the Service may only be available for use in the United States.
Identity Verification. To use your Account balance to send money to another Cashex customer or use certain Cashex products or services, you must provide information that we use to verify your identity. You represent and warrant that the personal information you provide to us is correct and that you own the email address or phone number you register with. You agree to cooperate with us so that we can verify your identity (including by providing government-issued ID) and we may use third parties to help us do so.
Account Information. To register, open, or upgrade an Account, the Company may require you to submit certain information about yourself and your business to the Company, including but not limited to your legal name, email address, text-enabled mobile phone number, street address, ZIP code, date of birth, Social Security number (or other taxpayer ID), government-issued ID, legal business name, business address, business taxpayer ID, and any information you subsequently add or update (“Account Information”). You represent and warrant that all Account Information you provide the Company to register, open, upgrade, or switch an Account is true and accurate, and you agree to keep all Account Information current. All Account Information is subject to Cashex’s Copyright and Trademark Policy.
Restricted vs. Unrestricted Accounts. When you first open your Account, it will be a “Restricted Account.” With a Restricted Account, you may link an external, U.S.-issued bank account (an “Eligible Bank Account”) to make a payment to another Cashex customer (including payments made to a Cashex for Business Account), and you may transfer funds from your Cashex Balance (defined below) to your Eligible Bank Account, but you will not be able to make a payment to another Cashex customer using your Cashex Balance or use certain Services (e.g., Peer-to-Peer, Cashex Investing). If you have a Restricted Account and you attempt to make a peer-to-peer payment from your Cashex Balance or use certain Services, you will have the option of upgrading your Account to an “Unrestricted Account.” To upgrade your Account, you will need to provide us with additional information so that we can verify your identity.
Validating and Authenticating Your Identity. You authorize the Company, directly or through third parties, to make inquiries as necessary to validate or authenticate your identity and Account Information (and for Cashex for Business Accounts, the identity of the business). This may include asking for more documentation or verifying information against third-party databases. When we successfully verify your identity, your Account will convert from a Restricted Account to an Unrestricted Account.
If you decline to provide us with requested information or we cannot verify your identity to our satisfaction (in our sole discretion), your Account will remain a Restricted Account, and you will not be able to use your Cashex Balance for peer-to-peer payments or certain other Services. We reserve the right to change account types, suspend, or terminate your Account or access to certain Services if you provide inaccurate, untrue, or incomplete information.
When you access your Account from a new device for the first time, we may require additional authentication. If your Account cannot be verified, you may need to set up a new Account.
2. Sponsored Accounts
Eligibility. If you are at least 28 years old, you may authorize usage of Accounts for minors who are 16 to 17 years old (each a “Sponsored Person” and each such Account a “Sponsored Account”). You must be at least 15 years older than the Sponsored Person. By authorizing a Sponsored Account, you represent that you are either (1) the Sponsored Person’s biological or adoptive parent, or (2) the Sponsored Person’s legal guardian (legal guardian, foster parent, stepparent living in same household, or grandparent living in same household).
Ownership & Responsibility. References to your “Account” include any associated Sponsored Accounts. You acknowledge that these Cashex Terms and Privacy Notice apply to you with respect to each Sponsored Account and Sponsored Person. You accept full responsibility for use of a Sponsored Account, including any transactions, fees, or liabilities (e.g., taxes) incurred by the Sponsored Account. You acknowledge that you—and not the Sponsored Person—are the legal owner of the Sponsored Account and of funds held within.
By authorizing a Sponsored Account, you authorize that Sponsored Person to control and withdraw funds from the Sponsored Account subject to any feature access requirements. Only the Sponsored Person may be able to access or transact using the Sponsored Account in the Cashex mobile and web applications. The Sponsored Person’s actions with respect to the Sponsored Account have the same force and effect as if you had done them yourself, so we may rely on any instruction from the Sponsored Person regarding the Sponsored Account.
You allow us to discuss the Sponsored Account with the Sponsored Person. By authorizing a Sponsored Account, you represent that you have permission to allow us to use and share information about the Sponsored Person as described in the Privacy Notice and as allowed by applicable law.
Withdrawing Authorization. You may withdraw your authorization at any time by contacting Cashex Support through the app or by calling 1-800-969-1940. If your own Account is suspended or terminated, any Sponsored Accounts you administered will be automatically withdrawn. If your authorization for a Sponsored Account is withdrawn, any funds in the Sponsored Account’s Cashex Balance will remain in that Sponsored Account, but access to features may be limited (except withdrawals to an Eligible Bank Account). The Sponsored Person may request a new sponsor. We reserve the right to terminate your Account if any Sponsored Person associated with you violates these Cashex Terms.
If a Sponsored Account is terminated, suspended, or closed for any reason, Sections XX.8 (Termination of Account), XX.9 (Effect of Termination), and XX.10 (Services Upon Closure of Account) will apply.
Feature Access. Sponsored Accounts have access to certain Cashex features (e.g., Peer-to-Peer, Cashex Balance), but access may be limited. You and the Sponsored Person may be required to accept additional terms or provide further information to Cashex to access certain features. By authorizing a Sponsored Account, you also authorize the Sponsored Person to “Add Money” to the Sponsored Account as outlined in Section VI.2. If any “Add Money” method is offered through a third party, you assume full responsibility for any use of that service by the Sponsored Person.
Limits for Sponsored Accounts. We may impose transaction limits on Sponsored Accounts in our sole discretion. The maximum amount that can be added to a Sponsored Account Cashex Balance by direct deposit or bank transfer is $5,000 per day and $10,000 per rolling 30-day period.
Account Graduation. Any Sponsored Person who reaches age 18 must comply with eligibility and identity verification provisions in Section III.1. Once verified, the Sponsored Person becomes the sole owner of their Sponsored Account, including all funds and assets. If the Sponsored Person does not provide required information or cannot be verified, Cashex may restrict or close the Sponsored Account, potentially liquidating any holdings.
Allowances. You may set up recurring peer-to-peer payments to your Sponsored Accounts on a weekly, bi-weekly, or monthly basis. These payments count toward transaction limits.
Taxes. As the owner of the Sponsored Account, you are responsible for any tax consequences of the Sponsored Account’s activity.
3. CashID
You may choose a unique identifier for Cashex, which will be your “CashID.” If you choose a CashID that is confusing, deceptive, or creates an undue risk of chargebacks or mistaken payments, we may require you to change it. We reserve the right, in our sole discretion and without liability, to require you to change your CashID or Account Information, and to deactivate your Account or reclaim or make unavailable your CashID.
4. Cashex Fees
The fees for using Cashex are listed in Section I (Stored Balance Disclosures). We reserve the right to charge or change fees associated with the use of Cashex at any time subject to reasonable notice and these Cashex Terms. A fee may be imposed by the Company or an ATM operator for use of networks or for third-party services.
5. FDIC Pass-Through Insurance
Eligibility & Coverage Limits. Cashex is a financial services platform, not an FDIC-insured bank. FDIC insurance covers only the failure of an FDIC-insured depository institution. If you have a Cashex Card (when available) or a Sponsored Account, or if you sponsor one or more Sponsored Accounts, your Cashex Balance and savings balance may be eligible for FDIC pass-through insurance through Program Banks (Wells Fargo Bank, N.A., Member FDIC; Sutton Bank, Member FDIC) if certain conditions are met. FDIC insures up to $250,000 per customer when aggregated with all other deposits in the same legal capacity at each Program Bank. If you have multiple Cashex accounts (including Sponsored Accounts), they are included under the same $250,000 limit.
If you do not have a Cashex Card (when available), a Sponsored Account, or sponsor a Sponsored Account, your Cashex Balance and savings balance are not eligible for FDIC pass-through insurance. FDIC pass-through insurance does not cover C$H holdings, Virtual Currency, or Cashex Investing holdings.
Exclusion of Pending Funds. Funds are eligible for FDIC insurance only when they are received and held by a Program Bank. When you deposit money into your Cashex Balance via an External Account, our Program Bank must receive those funds from the third party. While we may provide immediate or early access to funds, there may be a delay before our Program Bank receives them; during that delay, those funds are not FDIC-insured. Pending balances are not subject to FDIC pass-through insurance.
Program Banks. Eligible funds are placed in one or more Program Banks for FDIC insurance, subject to conditions. Program Banks currently are:
• Wells Fargo Bank, N.A., Member FDIC
• Sutton Bank, Member FDIC
We may add or remove Program Banks at any time without notice and update this section accordingly.
6. Gift Cards
Cashex may permit you to send a “Gift Card” for a designated merchant to a Recipient, who must have a Cashex Account. To redeem a Gift Card, the Recipient must have a Cashex Card (when available). Gift Cards are not redeemable for cash value, except that Recipients with a Cashex Card may redeem remaining value once the Gift Card balance falls below $10. Gift Cards can only be used with a Cashex Card purchase at the designated merchant.
If the Recipient does not have a Cashex Card, they may elect to add the cash value to their Cashex Balance, or request a Cashex Card and then accept the Gift Card. If not accepted within 30 days, the cash value will be added to the Recipient’s Cashex Balance.
Cashex does not guarantee Gift Card availability for any merchant. There are no fees to send or accept a Gift Card; once accepted, it does not expire. Minimum send amount is $1; maximum is $2,000 per sender per day. If a Recipient accepts multiple Gift Cards for the same merchant, they combine into one balance for that merchant.
IV. Communications and Devices
1. Text Messages and Other Communications
By providing us with a mobile number when registering or updating your Account, you consent to receiving text (SMS) messages and push notifications from us, including requests for secondary authentication, receipts, reminders, account notifications, marketing, or promotional messages. You acknowledge that standard message and data rates may apply.
If you provide Cashex with someone else’s mobile number when sending a payment, you represent and warrant that person has consented to receive text messages from us. Standard messaging rates may apply per their carrier plan.
You may opt out of promotional email communications by unsubscribing via the email. You may opt out of promotional phone calls by informing the caller. You may opt out of text messages by replying “STOP” or changing notification preferences in the app. Opting out may impact your use of the Services.
2. Compatible Mobile Devices and Third-Party Carriers
We do not warrant that the Services will be compatible with your mobile device or carrier. Your use of the Services may be subject to your agreements with your device manufacturer or carrier. You may not use a modified device (e.g., jailbroken) if it violates the manufacturer’s guidelines.
V. Data and Service Usage and Ownership
1. Your Content
You retain all rights to content you upload into our Services (“Content”), but grant us broad rights to use, modify, and display your Content in connection with providing, promoting, and improving the Services. You grant us and our affiliates a worldwide, non-exclusive, royalty-free, fully-paid, transferable, irrevocable, perpetual, sublicensable right to use, reproduce, modify, adapt, publish, prepare derivative works of, distribute, publicly perform, and publicly display your Content throughout the world in any media. You may modify or remove your Content via your Account or by terminating your Account, but your Content may persist in archived or cached copies.
You warrant that any Content you provide does not violate any third-party rights or contain objectionable material (illegal, obscene, hateful, defamatory, etc.). We may remove any Content at any time for any reason without notice. We have no obligation to monitor Content but reserve the right to do so. You understand that by using the Services, you may be exposed to offensive or objectionable Content; we assume no liability for any Content, including any loss or damage.
2. Security
We implement technical and organizational measures to secure your personal information, but cannot guarantee that unauthorized third parties will never gain access. You are responsible for safeguarding your password and restricting access to the Services from your devices. Notify us immediately of any unauthorized use of your password or Account. In disputes over account ownership, we will be the sole arbiter and our decision is final.
3. Your License
We grant you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to use the Services as authorized in these Cashex Terms. We may make updates available, which you must accept to continue using the Services, ensuring you run the most recent version of the app. Any such updates may be subject to additional terms.
4. Ownership
We own all rights, title, and interest in and to the Services and all copies thereof. These Cashex Terms do not grant you any rights to our trademarks or service marks. For the purposes of these Cashex Terms, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights.
If you submit feedback, comments, or ideas (“Ideas”) about the Services, submission is voluntary, and we may use such Ideas as we see fit without obligation to you.
5. Sharing of Your Information
We will share Account Information and transaction details (name, amount, description) with the other party to your transaction and in accordance with our Privacy Notice.
6. Copyright and Trademark Infringement
We respect intellectual property rights and have adopted a Copyright and Trademark Policy for third-party claims of infringement. We will respond to valid notices of infringement and may suspend or terminate accounts of repeat infringers.
VI. Cashex Balance
1. General
Your Cashex Balance consists of funds in your Account available for new transactions and not subject to pending transactions (“Cashex Balance”). You are responsible for all funds needed to complete payments. If you initiate a payment that exceeds your Cashex Balance, you authorize us to charge your Eligible Bank Account or linked debit card for any shortfall plus applicable fees.
Functionality. The Cashex Balance can be used to send money, receive money, and fund Services. You agree to reimburse the Company for any fees or costs we incur due to insufficient funds when you initiate a payment.
Authorization. By instructing us to add funds from your linked Eligible Bank Account or debit card to your Cashex Balance or to make any transfer, you authorize us to immediately debit those sources. You also authorize us to move funds back to those sources for canceled or returned transactions. You can cancel this authorization by unlinking your Eligible Bank Account or debit card.
Limitations. The Company may impose limits on the amount you can store in your Cashex Balance and reserves the right to change these limits at any time. If you have a Restricted Account, you may not use your Cashex Balance to make payments until you upgrade to an Unrestricted Account.
2. Funding Your Cashex Balance
Once you have an Unrestricted Account, you may “Add Money” to your Cashex Balance in several ways, including:
a. External Account.
• Eligible Bank Account: You may link a U.S.-issued bank account to fund your Cashex Balance.
• Debit Card: You may link a U.S.-issued debit card (Visa, MasterCard, or Discover) to fund your Cashex Balance. Collectively, your debit card, Cashex Balance, and Eligible Bank Account (if you have an Unrestricted Account) are your “Eligible Transaction Accounts.”
b. Direct Deposit. You may direct payments (paychecks, government benefits) into your Cashex Balance using the bank routing and account number provided by us (“Direct Deposit”). The maximum per-transaction Direct Deposit is $25,000.
c. Mobile Check Capture. Subject to Section XV (Mobile Check Capture), we may offer the ability to deposit checks to your Cashex Balance via our mobile check capture feature.
Funding features (e.g., cash loads, Direct Deposit) may be unavailable or delayed due to risk-based restrictions, maintenance, changes to Services, or outages.
3. Transferring Funds to Your Bank Account
You can transfer funds from your Cashex Balance to your Eligible Bank Account. These transfers can take up to three business days; for a fee, you can opt for an instant transfer. We may limit transfers based on fraud or risk. You remain responsible for any amounts owed even after your Account closes.
a. Transfers to Bank Account. You may electronically transfer funds (“Withdraw”) by initiating an ACH transfer to an Eligible Bank Account. These ACH transfers typically arrive within three (3) business days and cannot be canceled once initiated.
b. Instant Transfer. If available, you may Withdraw via Instant Transfer to your Eligible Bank Account for a fee (0.5%–1.75%, disclosed in-app). Funds are typically available within minutes.
c. Limitations. We may limit the number or amount of Withdrawals you can initiate. We may delay or limit transfers to protect against reversals, chargebacks, claims, fees, fines, or penalties. We may hold funds if you attempt to transfer while under investigation or if required by law, subpoena, court order, or government request. You remain liable for all obligations related to your Account even after closure.
4. Cashex Savings
Cashex offers a savings feature (“Cashex Savings”) described in the Cashex Savings Terms of Service. If eligible and you choose to use Cashex Savings, you agree to those terms.
5. Treatment of Funds
Funds held in your Cashex Balance and/or Savings Balance are held separate from Company corporate funds and not used for corporate purposes. We may combine your funds with those of other customers into pooled bank accounts in the Company’s name.
By maintaining funds, you appoint the Company as your agent to hold your funds at our Program Bank(s) or brokerage. This includes the right to conduct cash management via overnight sweep operations (to bank, money market mutual funds, or third-party brokerages). Funds at Program Banks remain FDIC-insured (subject to limits). Funds at a brokerage are not FDIC-insured; securities may be SIPC-protected. You can only access funds through Cashex; they cannot be obtained directly from Program Banks or brokerages.
6. Interest
Unless you are enrolled in savings yield (Cashex Savings), you irrevocably transfer and assign to the Company all rights in any interest accrued on your Cashex Balance funds held by the Company on your behalf.
7. Free Overdraft Coverage
a. General. We offer an optional, no-fee, non-recourse overdraft feature (“Free Overdraft Coverage”) allowing you to overdraw on your Cashex Balance for Cashex Card purchases (excluding ACH transfers, cash back, and ATM withdrawals) up to a specified limit (no greater than $200).
b. Eligibility. Eligibility is determined by Cashex in its sole discretion. Generally, you must have received at least $300 in qualifying direct deposits in the preceding calendar month. You must continue to meet direct deposit requirements to maintain eligibility.
c. Fees. No fees or interest are charged to use Free Overdraft Coverage. Related service fees (e.g., third-party fees) may still apply.
d. Repayment. Funds deposited to your Cashex Balance with an overdraft will automatically pay off the overdraft (“autopay”). You may opt out of autopay and repay manually in-app. There is no obligation to repay; Cashex will not pursue debt collection, place the balance with a third party, or report to credit agencies if unpaid.
e. Cancellation. You may cancel Free Overdraft Coverage in-app at any time; future overdrafts will be declined. Cashex may suspend or terminate your overdraft coverage at any time, including for nonpayment within 90 days. We are not liable for any costs associated with termination of overdraft coverage.
VII. Peer-to-Peer Service
1. Description of Service
The peer-to-peer Service (“Peer-to-Peer Service”) allows you to send or receive funds for personal, non-commercial purposes.
2. Sending Funds
To send funds, you must have a linked Eligible Bank Account (or debit card) and, if using your Cashex Balance, an Unrestricted Account. You authorize us to move funds on your behalf. We are not liable for incomplete transactions in certain circumstances (e.g., inaccurate instructions).
a. General. Once you have an Account and either funds in an Eligible Transaction Account or a linked eligible credit card (Visa, MasterCard, Discover, or American Express), you can send funds. Your Cashex Balance is not an “Eligible Transaction Account” until you provide information and we verify your identity. Until then, you cannot use your Cashex Balance to send funds. With a Restricted Account, you cannot send funds using your Cashex Balance; you must link a bank account or credit card or upgrade to Unrestricted. A “Payment Instruction” designates a recipient and amount for a peer-to-peer payment (“P2P Payment”).
b. Authorization. By initiating a Payment Instruction, you authorize us to debit your linked Eligible Transaction or Credit Account and send funds to the recipient immediately. You also authorize us to move funds back to your funding source for canceled or returned payments. You can cancel this authorization by unlinking your Eligible Bank Account.
Once you initiate a P2P Payment, processing begins immediately and funds leave your Eligible Transaction Account. We will complete transfer to the recipient once they provide required information, and you authorize us to retain funds until that occurs or up to fifteen (15) days.
c. Our Liability. We are not liable if we cannot complete a P2P Payment due to inaccurate or insufficient instructions, recipient failure to claim the payment, failure to provide requested information, or inability to verify identities.
3. Funding Sources Used for Peer-to-Peer Payments
You may link an Eligible Bank Account to fund payments. Cashex reserves the right to limit which banks or account types constitute an Eligible Bank Account.
If you have a Restricted Account, you cannot use your Cashex Balance; you may use an Eligible Bank Account or Eligible Credit Account.
With an Unrestricted Account and sufficient Cashex Balance, you may choose whether to use Cashex Balance, Eligible Bank Account, or Eligible Credit Account. If your Cashex Balance is insufficient, you may choose from your Eligible Transaction or Credit Accounts.
4. Requesting Funds
You may request funds from another Cashex user (“Cash Request”) by specifying the amount and sender. If approved, it becomes the sender’s Payment Instruction and is processed accordingly.
5. Receiving Funds
Any P2P Payment you receive is stored in your Cashex Balance.
6. Payment Amount Limits
We may require additional identification information if you wish to send amounts above thresholds to verify identity. We may impose transaction limits over any time period or account lifetime and adjust limits at our discretion.
7. Peer-to-Peer Service Fees
Sending funds via your Cashex Balance or linked bank account is free. If you choose to send via credit card, a fee applies (displayed at time of transaction). We reserve the right to change fees associated with the Peer-to-Peer Service with reasonable notice.
8. Payment Cancellation, Stop Payment Requests & Refused Payments
Our ability to cancel or stop a P2P Payment depends on initiation method and processing status. We are not required to stop or recover a misdirected payment.
P2P Payments not claimed by the recipient within fifteen (15) days of processing will automatically cancel. We attempt to return unclaimed, refused, refunded, or denied payments to your funding source; if not possible, we may use other reasonable means to return funds.
9. Invalid P2P Payments
If we believe you received a payment that should not have been made (e.g., fraud), you authorize us to reverse that payment. We are not liable for any payments you receive, even if unauthorized. If a payment you receive becomes invalid in our sole discretion, you authorize us to move an equal amount from your funding source. You agree we will not be liable for any invalid P2P Payments.
10. Risk of Fraudulent Transactions
Be vigilant against fraud and scams. While we attempt to identify and reduce scam impact, you are responsible for losses due to fraudulent or accidental transactions. For errors or disputes, see Section XI.
VIII. Virtual Currency Services (Including C$H)
These terms govern your use of Virtual Currency Services offered through Cashex, including our native cryptocurrency, C$H. Virtual Currency values can be volatile, resulting in sudden and substantial losses. Carefully consider whether transacting or holding Virtual Currency is suitable in light of your financial condition.
1. Definitions
Capitalized terms not defined here have the same meaning as in other Sections. In addition:
• “C$H” means Cashex’s native cryptocurrency.
• “External Virtual Currency Address” means any Virtual Currency address, wallet, or account outside the Services.
• “Fiat Currency” means U.S. dollars.
• “Hosted Balance” means Virtual Currency you purchase or deposit in your Virtual Currency Account.
• “Supported Network” means any blockchain network or protocol we make available.
• “Virtual Currency” means C$H and any other virtual currency we support.
• “Virtual Currency Account” means your account for Virtual Currency Services.
• “Virtual Currency Services” means Virtual Currency features available in Cashex (buy, sell, send, receive).
2. Virtual Currency Account
a. Eligibility. To access Virtual Currency Services, you must:
Have a Cashex Account.
Be an individual (not an entity), using Virtual Currency Services for personal use.
Be a U.S. resident at least 16 years old.
Use the Virtual Currency Services in the United States.
Provide additional required information (ID, bank details, source of funds, etc.).
b. Identity Verification. To use Virtual Currency Services, you may need to provide personal information including name, address, phone, email, date of birth, taxpayer ID, government ID, bank details, source of funds, and employment information. You verify that provided information is accurate and agree to update if it changes.
c. Availability. We may restrict Virtual Currency Services in certain states, territories, or jurisdictions. You must not attempt to circumvent these restrictions.
d. UCC Application. Virtual Currency in your Virtual Currency Account is treated as “financial assets” under Division 8 of the California Uniform Commercial Code (“UCC”). We are a “securities intermediary,” and your Virtual Currency Account is a “securities account.” This characterization does not determine status under other laws (e.g., Commodity Exchange Act).
e. Custody and Title. Virtual Currency held in your Virtual Currency Account are custodial assets held by us for your benefit. Title remains with you. We record ownership on our books. Virtual Currency you hold are not Company property and are not subject to our creditors’ claims. Except as required by law or these Terms, we will not sell, transfer, loan, hypothecate, or otherwise alienate your Virtual Currency unless instructed by you.
3. Purchasing Virtual Currency (C$H and Others)
a. Funding. To buy Virtual Currency, you must hold Fiat Currency in your Cashex Balance.
b. Authorization. When you submit a purchase order (“Buy”) via Virtual Currency Services, you authorize us to execute the purchase and debit your Cashex Balance for the transaction amount plus any fees.
c. Buy Transaction. To Buy, select the amount of Virtual Currency to purchase using Fiat in your Cashex Balance, tap “Buy,” and confirm. Your Cashex Balance must have sufficient funds. A Buy is a sale from us to you; once complete, your Hosted Balance reflects the Virtual Currency purchased. All right and title pass to you. A Buy may not always broadcast a transaction to the blockchain network immediately.
d. Recurring Buys & Auto-Invest. You may set up recurring Buys to purchase Virtual Currency at periodic intervals (e.g., daily, weekly, monthly) from your Cashex Balance or Eligible Bank Account. If Cashex Balance is insufficient, you authorize us to pull from your Eligible Bank Account. Recurring Buys execute as market orders at the then-effective Conversion Rate. Execution time may vary from day to day. We may set minimums. If insufficient funds persist, we may retry or cancel. You may cancel Recurring Buys at any time. We may cancel or modify them at our discretion.
e. Round-Ups. If enabled, Round-Ups purchase C$H each time you use your Cashex Card (when available) by “rounding up” your purchase to the next whole dollar upon transaction settlement and using the round-up amount to buy C$H at the then-effective Conversion Rate. Settlement can take 1–3 days; tips changes can alter transaction amounts. We may set minimums. You may disable Round-Ups anytime, but pending Round-Ups may still occur. We may cancel or modify them. If insufficient funds, we may retry or cancel. If a Round-Up results from an unauthorized Cashex Card transaction, you can dispute it via Cashex Support.
f. Square Bitcoin Conversions (if applicable). If you have a linked Square Account, you may convert a percentage of your Square sales proceeds daily into C$H via market orders at the then-effective Conversion Rate. Funds used are yours personally; purchased C$H is for personal use only. C$H acquired this way cannot return to the Square Account. Cancel or adjust anytime in your Square Account. Conversions continue until you or we cancel. We may set eligibility criteria and cancel conversions at our discretion.
g. No Guarantee. We do not guarantee the availability of Buys. Purchasing Virtual Currency does not guarantee later availability.
h. Settlement. We use commercially reasonable efforts to complete purchases within two business days of initiation.
4. Transferring Virtual Currency
a. Withdrawals. You may transfer Virtual Currency (including C$H) from your Hosted Balance to an External Virtual Currency Address (“Virtual Currency Withdrawal”) minus applicable fees. You are responsible for providing accurate withdrawal instructions; we are not liable for delays or loss due to incorrect instructions. Withdrawals cannot be reversed once initiated. We do not control blockchain networks and cannot guarantee confirmation or execution.
b. Deposits. You may transfer Virtual Currency from an External Virtual Currency Address to your Hosted Balance (“Virtual Currency Deposit”) minus fees. Only supported Virtual Currencies may be deposited, and deposits must conform to required protocols. You are responsible for executing deposits correctly, including network fees. We are not responsible for erroneous or delayed deposits for any reason (e.g., wrong address). Deposits must reach required network confirmations before appearing in your Hosted Balance; delays may occur.
c. Transfer Limitations. We may, in our sole discretion, impose limitations on size, type, or frequency of transfers.
d. Transfer Fees. We may charge fees for deposits or withdrawals, including network fees, displayed at or before confirmation.
e. Compatibility. Only supported Virtual Currencies may be transferred to/from your Hosted Balance. We are not responsible for unsupported Virtual Currency transfers or network incompatibilities.
f. Transfer Settlement Risk. Pending withdrawals remain pending until network confirmations. If a withdrawal fails, the amount returns to your Hosted Balance. You bear loss risk once a transfer is initiated and not yet confirmed if Virtual Currency value changes during delay. We are not responsible for errors in initiation or remediation.
g. Third Parties. We are not responsible for goods or services you receive from third parties or actions by third parties regarding Virtual Currency transfers. Disputes with third parties must be resolved directly.
5. Selling Virtual Currency
a. Sell Transaction. To sell Virtual Currency, select the amount to sell from your Hosted Balance and tap “Sell.” We will purchase the Virtual Currency and deposit equivalent Fiat into your Cashex Balance. The price received may vary based on market factors (price, volume).
b. No Guarantee. We do not guarantee availability of Sell transactions or your ability to sell at any time. Selling Virtual Currency to us does not guarantee future availability.
6. Peer-to-Peer Virtual Currency Transfers
You may send Virtual Currency (including C$H) peer-to-peer to other Cashex customers (“P2P Virtual Currency Transaction”). These transfers are “off-chain” and are not broadcast to the public ledger; instead, they are internal ledger adjustments by the Company. All Virtual Currency remains custodied by Cashex. Recipients must hold a Virtual Currency Account; if they do not, they must open one within the required period or the transfer will be voided and returned to you. Once you accept a P2P Virtual Currency Transaction, subsequent transfers will automatically complete into your Hosted Balance.
We reserve the right to charge fees for P2P Virtual Currency Transactions and to change fees at any time. Fees appear in-app at or before confirmation. We may impose transaction limits in our discretion. Fraudulent transactions may result in irrecoverable loss. You are responsible for providing accurate instructions; Cashex is not responsible for transfers based on inaccurate instructions. P2P Virtual Currency Transactions occur in Virtual Currency denominations; estimated dollar amounts are based on the then-effective Conversion Rate and are not guaranteed. The value of Virtual Currency can fluctuate rapidly; Cashex does not guarantee dollar value of transfers and recipients bear any resulting losses.
7. Fees
We may charge fees for Virtual Currency transactions (buy, sell, transfer, network transactions). For each transaction, you agree to pay the fees shown at or before confirmation. We may change fees at any time, with or without notice.
8. Conversion Rate
When buying or selling Virtual Currency, any such transaction is subject to the “Conversion Rate”: the price in Fiat displayed once you select “Buy” or “Sell.” We may add a margin or “spread” between the quoted mid-market price and the buy/sell price. The buy price Conversion Rate may differ from the sell price Conversion Rate at any time. You agree to accept the Conversion Rate as the sole conversion metric; you are not obligated to accept the offered rate.
9. Risk Disclosure
GENERAL: Virtual Currency values can fluctuate substantially, potentially resulting in total loss of value. Supply and availability depend on third-party providers outside our control; we make no promises on timing of purchases, sales, or transfers. We do not own or control any software protocols used for Virtual Currency purchases, sales, or transfers; accordingly, we disclaim all liability relating to such protocols and price fluctuations.
FORKS: Underlying protocols may change operating rules (“forks”), which can materially affect the Virtual Currency’s value, function, or name. In a fork, we may suspend operations and decide whether to support either fork. We assume no responsibility for unsupported forks.
SYSTEM FAILURE: You accept all risks associated with Virtual Currency Services, including hardware, software, internet, or Supported Network failures that may prevent access or use of your Virtual Currency.
Disruption Events: In the event of material market events or other circumstances, we may suspend access to Virtual Currency Services or prevent transactions. We will not be liable for losses due to such actions. Upon resuming services, market rates, including Conversion Rate, may differ significantly.
Limitation of Liability: Our responsibility is limited to ordinary diligence in operating Virtual Currency Services and giving access to your Virtual Currency. We are not responsible for unauthorized access or losses unless due to our gross negligence or willful misconduct. You have no claim against us for Virtual Currency loss unless you prove the loss was not caused or contributed to by you.
Risks Inherent to Virtual Currency:
(a) Virtual Currency transactions are irreversible; losses due to fraudulent or accidental transactions may not be recoverable.
(b) Virtual Currency is not legal tender and not backed by a government or central bank; no deposit insurance exists.
(c) Regulatory changes may adversely affect use, transfer, exchange, and value of Virtual Currency or Supported Networks.
(d) Supported Networks are maintained by private, unidentified networks globally; you participate at your own risk.
(e) Virtual Currency is a fraud target, especially with External Virtual Currency Addresses.
(f) Virtual Currency is a hacking target; your Virtual Currency may be stolen despite strong security.
(g) Linking bank accounts to Virtual Currency accounts can increase hacking risk.
(h) Some transactions are deemed made when recorded on a public ledger, not necessarily when initiated.
(i) Virtual Currency value depends on market willingness to exchange Fiat; if market disappears, you may lose all value.
(j) No assurance that merchants accepting Virtual Currency today will do so in future.
(k) Volatility can result in significant loss in short periods.
(l) Any bond or trust held by the Company may not cover all losses incurred by customers.
10. Transaction History
Transaction information will be reflected in your Cashex transaction history. Delays or failures in providing transaction info do not affect transaction validity.
11. Use of Virtual Currency Services
a. Conditions and Restrictions. We may refuse any transaction, impose limits on amounts, or impose conditions/restrictions without notice. We may make Virtual Currency Services unavailable at any time. If unavailable, any in-progress requests will be canceled.
b. Cancellations. You may not cancel buy, sell, or transfer requests via Virtual Currency Services. Once submitted, you cannot change, withdraw, or cancel your authorization.
c. Insufficient Funds. If you lack sufficient Cashex Balance to purchase requested Virtual Currency, you cannot complete the transaction.
d. Taxes. You are responsible for taxes resulting from transactions under Virtual Currency Services and for reporting and remitting taxes. We are not responsible for determining your tax obligations. If required by law, we may deduct or withhold amounts. Amounts withheld are treated as paid for purposes of these Terms. You certify information provided is accurate and consent to our use of it for tax purposes.
e. Currency Availability. We may determine which Virtual Currencies are available in Virtual Currency Services, adding or removing them at any time. We will reasonably notify you of likely removal. If a Virtual Currency is removed, you have 30 days to withdraw remaining amounts to an External Virtual Currency Address; if not withdrawn, amounts are not discarded but require contacting Cashex Support to arrange withdrawal. We are not liable for any losses related to removal.
f. Independent Relationship. We are not your broker, intermediary, agent, or advisor. Information provided is not advice.
12. Suspension; Termination; Discontinuance of Virtual Currency Services and Virtual Currency Account
a. Suspension/Termination of Services. We may limit, suspend, modify, discontinue (temporarily or permanently) any part of Virtual Currency Services with or without notice to protect us, users, or employees, or if required by law or court order. We are not liable for consequences of refusing access, including delays or inconvenience.
b. Suspension/Termination of Virtual Currency Account. We may suspend or terminate your Virtual Currency Account or access to any Virtual Currency Services at any time. If suspended or terminated, we will notify you but may not disclose details. We may liquidate all assets in your Virtual Currency Account; we are not liable for losses or tax liabilities due to liquidation.
c. Suspension/Termination/Reversal of Transactions. We may suspend, refuse, freeze, decline, delay, redirect, or reverse any transaction (buy, sell, or transfer) for suspected money laundering, fraud, illegal activity, in response to legal orders, or if we investigate a transaction. We do not guarantee you can reinitiate a canceled or reversed transaction at the same price or terms. You are responsible for any reversals, chargebacks, claims, fees, fines, or penalties resulting from your breach of these Terms or your use of Virtual Currency Services. We will notify you if we suspend, terminate, or reverse a transaction.
13. C$H (Native Cryptocurrency)
a. Definition & Purpose. C$H is Cashex’s native cryptocurrency used for transactions within Cashex and partner merchants. C$H can be bought, sold, sent, and received via Virtual Currency Services.
b. Purchase & Sale. You may buy C$H per Section VIII.3. To sell C$H, follow Section VIII.5. All C$H transactions are subject to the Conversion Rate, as described in Section VIII.8.
c. Staking Rewards (If Offered). Cashex may offer C$H staking for Account holders: you can “stake” (lock up) C$H in your Hosted Balance to earn periodic rewards (in C$H or Fiats). Staking terms (e.g., minimum threshold, lock-up period, reward rate, reward schedule) will be displayed in-app. You acknowledge staking is voluntary and carries risks, including potential loss of staked C$H if network or protocol issues occur. Rewards are not guaranteed and may fluctuate based on network conditions and protocol rules. We reserve the right to modify or suspend staking terms at any time.
d. Use Cases. C$H may be used:
• To pay transaction fees at a discount.
• For peer-to-peer transfers.
• To pay participating merchants and service providers.
• To participate in certain promotional events and rewards (e.g., C$H-exclusive offers).
Cashex and partners determine acceptance of C$H; availability may vary. Terms and conditions for C$H use are subject to change.
e. Token Mechanics & Supply. C$H is an ERC-20 token (or similar) on a Supported Network. Total supply, issuance schedule, and tokenomics outline are available in our Whitepaper. We may burn, mint, or otherwise adjust supply per governance protocols or in our discretion.
f. Risks & Disclaimers. C$H value may be highly volatile, leading to partial or total loss. You assume all risk. C$H is not legal tender, not backed by any government or central bank, and has no cash value except as a medium of exchange on Supported Networks or with participating merchants. There is no FDIC or SIPC insurance on C$H holdings. You bear all tax liabilities associated with C$H transactions.
g. Governance & Updates. We may propose protocol upgrades or changes to C$H network rules. If an upgrade occurs (hard fork), Cashex may support or discontinue support for certain forks at our discretion. We assume no responsibility for unsupported forks.
14. Virtual Currency Custom Orders (C$H Advanced Orders)
Cashex may offer Custom Orders to buy or sell C$H at a specified trigger price. If supported, you can set a “Trigger Price,” select an amount of C$H, and choose an expiration. If C$H’s Conversion Rate meets the Trigger Price, Cashex executes the buy or sell. You authorize Cashex to pull required funds or C$H at initiation. Your Custom Order executes only if the Conversion Rate matches the Trigger Price in our discretion. You may cancel before the Trigger Event; if canceled or expired, funds or C$H return to your Account. We may cancel or modify Custom Orders at any time. Custom Orders carry additional risks; you should understand Virtual Currency transaction risks before placing one. Cashex is not liable if service outages prevent placing or canceling Custom Orders.
15. Virtual Currency Gifting
You may send a Virtual Currency-denominated gift (e.g., C$H gift) to another Cashex user (“Virtual Currency Gift”). The sender sends Fiat via P2P to the recipient. The recipient is prompted to purchase C$H with the received Fiat. The recipient may decline to purchase or accept as Fiat. If unaccepted within 21 days, the Gift is returned to the sender if from another user, or returned to Cashex if promotional. After receiving a Virtual Currency Gift, the recipient must place a Buy order to acquire C$H; such order is at the recipient’s direction. The value of C$H at send time may differ from time of purchase; recipients bear any loss. Selling acquired C$H incurs tax consequences, for which we provide no reimbursement. Consult a tax advisor.
16. Sponsored Accounts & Virtual Currency
a. Authorization. You may enable Virtual Currency Services for Sponsored Accounts if your Account is eligible.
b. Ownership & Responsibility. Virtual Currency held by a Sponsored Account is owned by you; all gains, losses, liabilities, and tax consequences are yours.
c. Control. By enabling Virtual Currency Services for a Sponsored Account, you authorize the Sponsored Person to transact in Virtual Currency without prior approval, including selling C$H. Only the Sponsored Person may access the Sponsored Account; you cannot transact on their behalf. Sponsored Person’s actions have the same force as if you made them. You assume all risks. You can revoke authorization at any time.
d. Supervision. You are responsible for monitoring Sponsored Account activity, including any losses. Promptly review activity and contact us with concerns. It is your responsibility to suspend or revoke access if needed; we do not supervise Sponsored Account activity.
e. Graduation & Transfer of Assets. Once a Sponsored Person turns 18 and is verified, they assume sole ownership of the Sponsored Account and its assets. If unable to verify, Cashex may restrict or close the Sponsored Account and liquidate holdings.
f. Limits. Sponsored Accounts may face Virtual Currency transaction limits or restrictions. They may be unable to transfer assets out. We may liquidate holdings if closing the account. We reserve the right to impose additional limits at any time.
g. Life Events. You must promptly notify us of any change impacting your or the Sponsored Person’s ability to own or use a Sponsored Account. We will assist with sponsor transitions or account closures as needed.
h. Taxes. You are responsible for any tax consequences of the Sponsored Account’s Virtual Currency activity. Consult a tax advisor.
IX. Cashex Investing
1. Cashex Investing
If you want to buy stocks via Cashex, you must sign up with our broker-dealer, Cashex Investing LLC, a FINRA-registered broker-dealer and subsidiary of the Company. You must open a brokerage account with Cashex Investing and agree to Cashex Investing’s Terms and Conditions for such an account. By using any Cashex Investing services, you authorize and instruct us to follow instructions from Cashex Investing on your behalf regarding transmission or receipt of funds in your Cashex Balance.
2. Stock Gifting
Cashex may permit you to send a stock “Gift” to another person. When sending a Gift, you transfer Fiat to the recipient, who can then initiate a self-directed stock purchase of the identified stock. The Gift itself is not a security; it is Fiat. The recipient must have a Cashex Account and open a Cashex Investing brokerage account to use the Gift to purchase stock. If they do not accept the Gift within 21 days, the Gift returns to you.
When sending a Gift, the identified stock is chosen by you; Cash App Investing does not recommend any stock. Cashex Investing is self-directed; recipients are responsible for their trades. Investing is risky; stock value may lose value; Cashex and Cashex Investing are not liable for losses. The stock price may change between sending and purchase. Selling shares has tax implications; we do not provide compensation for tax consequences. Consult a tax advisor.
X. Cashex for Business
1. Opening a Cashex for Business Account
If you sell goods or services, you may open or switch to a “Cashex for Business Account” (“Business Account”). Your Business Account will be marked accordingly. You must have an Unrestricted Account and may need to provide additional information to open or switch to a Business Account.
If we determine you are using your Account to accept payments for goods or services, we may require you to open or switch to a Business Account and can terminate, suspend, or close your Account at our discretion.
2. Payment Terms
By opening or using a Business Account, you accept and agree to the Cashex for Business Payment Terms and attest that your Account is not primarily for personal, family, or household purposes. Business Accounts are for accepting payments for goods and services only.
3. Eligibility & Feature Availability
To open or switch to a Business Account, you may need to provide information about you or your business/legal entity to verify and approve the Account. We may determine which businesses are eligible. Certain businesses or legal entities may not be supported or may have limited access to features. Upon switching or upgrading, you may lose access to certain features and may need to liquidate or transfer assets in your Cashex Account.
4. Fees for Transaction Processing
If you have a Business Account, we charge a transaction processing fee for deposits of customer payments into your Cashex Balance. You authorize us to process transactions as your agent and to void transactions if we believe a chargeback will occur. Payments you receive, less fees, will be deposited to your Cashex Balance.
5. Purchases from Business Accounts
As a Cashex user, you may purchase goods and services from Business Accounts using your Account or linked card. By paying a Business Account, you authorize the seller to debit your applicable funding source. You can use your Cashex Balance for purchases only after identity verification.
Use of Balance. Cashex Purchases from Business Accounts may be identified by a badge or insignia. By initiating a payment to a Business Account, you authorize that seller to charge your Eligible Transaction Account or Credit Account and consent to sharing your account info. For refunds, you authorize credits to your original funding source. Purchases from Business Accounts with Credit or Bank Accounts are processed by Cashex as agent for the merchant.
XI. Transaction Information and Disputes
1. Receipts and Account Statements
You can find transaction receipts and Account statements in your Cashex account (Activity section) or by logging into your Account at cashex.global/account. You have the right to receive Account statements and view your transaction history (12-month and 24-month).
2. Error and Dispute Resolution
Contact us if you see any errors or issues with your Account or Remittance Payments. Different procedures apply depending on the type of issue.
a. Reporting a Problem (Non-Regulation E Transfers). If you notice a problem not covered by Regulation E (e.g., P2P, Cashex Balance), call us at 1-800-969-1940, write to Cashex Global Inc., Attn: Cashex Disputes, 1955 Broadway, Suite 600, Oakland, CA 94612, or use in-app chat. Provide notice within 60 days of receiving the statement reflecting the problem. We will investigate within a reasonable time.
b. Errors Under Regulation E (Unauthorized or Erroneous Electronic Transfers). If you believe there are errors on your Account governed by Regulation E (e.g., Cashex Balance transfers, ATM, debit), you can:
• Contact us in-app (some products support in-app dispute submission).
• Call 1-800-969-1940.
• Write to Cashex Global Inc., Attn: Cashex Disputes, 1955 Broadway, Suite 600, Oakland, CA 94612.
Report the error within 60 days of the first statement showing the error. Provide:
• Your name and Account info (CashID, email, phone),
• Why you believe there is an error,
• Dollar amount involved,
• Approximate date of the error.
If you notify us verbally, we may require written confirmation within 10 business days. We will investigate within 10 business days and correct errors promptly. If more time is needed (up to 45 days), we will provisionally credit your Account within 10 business days so you have funds during the investigation. If you don’t provide written confirmation within 10 business days, we may not provisionally credit. For new Accounts and POS transactions, we may take up to 90 days to investigate and 20 business days to credit provisionally. We will notify you of results within 3 business days after completing our investigation. If we find no error, we send a written explanation and you may request copies of documents used. For additional rights and timelines for Remittance Service errors, see Section XI.2.c.
c. Errors Related to Remittance Service (Regulation E, Subpart B). For remittance transfers (sending money abroad): Contact us within 180 days of the date we disclosed funds availability to the recipient. Provide:
• Your name and phone number or address,
• Description of the error or problem,
• Name and contact info of the recipient,
• Dollar amount of the transfer,
• Confirmation code or transaction number.
We will determine if an error occurred within 90 days and correct it promptly. We will notify you of results within 3 business days after investigation. If there was no error, we send a written explanation and you may request copies of documents.
Business Days. Monday through Friday (excluding federal holidays).
3. Your Liability for Unauthorized Transactions
Tell us AT ONCE if you believe your Cashex Card (if available) or Account credentials are lost, stolen, or used without permission (“Unauthorized Transaction”). Contact via app, call 1-800-969-1940, or write to Cashex Global Inc., Attn: Cashex Disputes, 1955 Broadway, Suite 600, Oakland, CA 94612.
If you notify us within 2 business days after learning of an Unauthorized Transaction, you lose no more than $50. If you wait longer and we prove we could have prevented the unauthorized use, you could lose up to $500.
If your statement shows transfers you did not make, you must tell us within 60 days of the statement date. If you fail to do so, you may not recover funds lost after 60 days if we could have prevented the loss. If a good reason (e.g., hospitalization) prevents timely notice, we will extend deadlines as appropriate.
If you have a Cashex for Business Account, you may be liable for all Unauthorized Transactions regardless of when reported.
Not an Unauthorized Transaction:
• If you give someone your login info and they use your Account (unless you notified us to revoke their access).
• If you or an accomplice acted fraudulently.
• Payment instruction errors due to incorrect recipient info do not count as Unauthorized Transactions.
4. Our Liability
When We Cover You (Completing Transactions). If we fail to complete a transaction on time or in the correct amount, we will be liable for your losses or damages in accordance with applicable law, except in cases such as:
• Insufficient funds in your Account or funding source.
• Funds subject to legal process or other encumbrance.
• ATM or merchant terminal malfunctions.
• Cashex malfunction known to you at transaction initiation.
• Circumstances beyond our control (fire, flood, power failure, strike, government action, natural disaster, etc.).
5. Disputes with Your Funding Source
If you dispute a transaction with your external funding source (e.g., your bank or debit card issuer), your rights are determined by that source’s policies. Filing a dispute with a third party does not constitute notice of error with Cashex. To resolve disputes with Cashex, follow procedures in Section XI.2.
XII. Cashex Offers
Cashex Offers (“Offers”) are promotional programs that allow you to save on qualifying transactions. Your use of Offers is subject to Cashex Offers Terms, incorporated here by reference. Offers are for personal use only; you may not use Offers for commercial purposes.
XIII. Cashex Local
Cashex Local (“CL”) is a promotional program that gives you rewards (“Local Cash”) for shopping with participating merchants (“Sellers”) in your area. When you tip at Sellers, you may earn Local Cash that can be used for later purchases at Sellers. For clarity, CL is part of Cashex Services under these Terms.
1. Eligibility
To claim and use Local Cash, you must have a Cashex Account in good standing. CL is for personal use only; you may not use it for commercial purposes. Certain items, product categories, payment methods, and checkout types may be ineligible. CL is available only in select locations on qualifying purchases at Sellers.
2. Local Cash
You can earn Local Cash equal to amounts you tip on purchases made with qualifying payment methods (“Qualifying CL Transactions”), subject to limits displayed in-app. Limits may change at any time. Local Cash has no cash value; it cannot be purchased, sold, or transferred, and is purely promotional. It can only be used for purchases at Sellers and may expire or be limited at any time at our discretion.
3. Accumulating, Claiming, and Using Local Cash
You accumulate Local Cash on tips at Sellers when you pay with Cashex Pay, Cashex Card (if available), or a recognized debit/credit card used after scanning a Cashex Local QR code at the point of sale (“Qualifying Instruments”). To claim and use Local Cash, you must join CL in-app. Local Cash can only be used on qualifying Cashex purchases at Sellers; cannot pay tips or tax. Local Cash is not earned on fraudulent, disputed, or returned transactions. Once used, Local Cash cannot be refunded.
4. Advertising and Marketing
You may receive automated informational and marketing texts about CL via your provided phone number.
5. Availability of Rewards
Local Cash typically appears in your Account within 24 hours of paying a tip and joining CL, but availability is not guaranteed within a specific timeframe.
XIV. Remittance Service
The Remittance Service enables you to send funds from the U.S. to individuals in certain other countries for personal, non-commercial purposes (“Remittance Service”).
1. Description of the Service
Eligible Unrestricted Accounts can use the Remittance Service. As Sender, you provide “Remittance Payment Instructions” (amount, currency, payout method, recipient identity, etc.) using funds in your Cashex Balance. Restricted Accounts cannot use the Remittance Service.
2. Sending Remittance Payments
a. Authorization. By initiating a Remittance Payment, you authorize us to debit your Cashex Balance for the specified amount, including fees and taxes, and send those funds to the Designated Recipient via chosen delivery method (cash pickup or bank deposit). Funds leave your Cashex Balance as soon as processing begins. If insufficient funds exist, your Cashex Balance may go negative, and we may recover funds per Section XX.1.
b. Method of Payout. Sender selects either (1) cash pickup at a partnered paying agent location or (2) deposit into the recipient’s bank account in the destination country.
3. Cancellations and Refunds
You have the right to cancel a Remittance Payment within 30 minutes of payment for a full refund (including fees), unless the recipient has already picked up the money or it has been deposited. To cancel, contact us via phone (1-800-969-1940) or in-app within 30 minutes, providing transfer details (amount, recipient location). We will refund your money within three business days if not picked up or deposited.
Automatic Cancellations. If cash pickup is selected and the recipient fails to pick up or verify identity within 21 days of availability, the transfer is canceled, and funds return to your Cashex Balance (minus fees if required by law). Refunds are processed within thirty (30) days of cancellation in USD.
4. Remittance Service Fees
Fees are detailed in Section I (Stored Balance Disclosures) and disclosed in-app before you submit a Remittance Payment Instruction. We reserve the right to change fees with reasonable notice, subject to these Terms and applicable law. Fees are due at submission.
5. Currency Exchange Rate
All Remittance Payments are funded in USD and paid in the destination country’s official currency (or an alternative payout currency, if available). We disclose the actual or estimated exchange rate before you submit payment and on your receipt. Disclosed rates may be rounded per applicable laws. Retail exchange rates for individual senders may differ from wholesale rates we obtain. The difference between retail and wholesale rates is retained by the Company and/or paying agent as revenue, in addition to any fees disclosed. The paying agent must pay out in the currency indicated on your receipt.
6. Payment and Transaction Limits
We may limit or require additional ID verification based on number of Remittance Payments over any period. We may impose limits on amount per transaction, multiple transactions over any period, or to certain countries. We may adjust limits at our discretion, subject to law.
7. Risk of Fraudulent Transactions
Remain vigilant for fraud and scams; losses from scams may not be recoverable.
XV. Mobile Check Capture
These Mobile Check Capture Terms govern your use of Mobile Check Capture, which lets you use Cashex (including the mobile app) to create and transmit electronic images of eligible paper checks for deposit into your Cashex Balance. Cashex reserves the right to suspend or terminate your Mobile Check Capture access at any time.
1. General Information
“Electronic Check” means the electronic image and associated information (including MICR data) from a paper check submitted via Mobile Check Capture. When you submit an Electronic Check, we may capture time, geolocation, and other device data. To use Mobile Check Capture, you must grant Cashex camera, file, device time, and geolocation permissions.
After we receive your Electronic Check, we will review it. We may decline any item at our discretion, even if it appears eligible. Keep the original paper check secure for two weeks because we may reverse acceptance. After two weeks, destroy or void the original unless we instruct otherwise. Do not use Mobile Check Capture to disrupt Cashex or conduct illegal activity.
2. Eligibility Requirements
We determine check eligibility in our sole discretion based on factors including, but not limited to:
• Payee equals you (or, for two-party checks, order is to you or another person),
• Physical check is in your possession when image is submitted,
• Drawn on a U.S. bank, credit union, or depository institution,
• Not drawn on another account owned by you,
• Payable in U.S. dollars,
• Properly signed by maker,
• Check amount does not exceed your personal or daily limits,
• Check date is in the past but not more than 180 days old,
• Check or electronic image has not been previously deposited,
• No prior dishonor of the check,
• Not altered except endorsement,
• Endorsed by you clearly and legibly,
• Endorsement reads “Cashex Deposit,”
• Not endorsed by anyone else or to another institution,
• Not previously dishonored,
• Complies with any additional requirements on check.
Ineligible checks include credit card checks, trust checks, estate checks, and checks payable to a business (including sole proprietorship).
3. Representations and Warranties
Each time you submit an Electronic Check, you represent and warrant that:
a. The paper check is an Eligible Check at submission,
b. All information you provide (e.g., manual entry of check amount) is true, accurate, and complete,
c. The Electronic Check image is clear, legible, and accurate, including MICR data, check date, payee name (you), maker’s signature, and your endorsement.
4. Post-Submission Requirements
After you submit an Electronic Check and receive confirmation in-app, you must secure the original paper check for two weeks. After two weeks, destroy or void it unless instructed otherwise. Ensure your contact information in Cashex is up to date; we may contact you regarding your check via email or text.
5. Dishonored Electronic Checks
If an Electronic Check is dishonored or returned unpaid (e.g., deemed fraudulent), we may deduct credited funds from your Cashex Balance. If we already made funds available, you may incur a negative balance, and we may recover funds per Section XX.1.
6. Claims by Drawee Bank
The bank accepting your check may have a claim against us if there are issues (e.g., duplicate presentment, forged signature, alteration, image-info mismatch). If we are subject to such a claim, we may recover amounts paid from you per the “Additional Cashex Terms of Service – Recovery of Funds.”
7. Funds Availability
a. Delays at Discretion. We may delay your access to funds from Successfully Submitted Electronic Checks at our discretion (e.g., fraud review, usage monitoring). Funds are not subject to Regulation CC.
b. “Successfully Submitted.” An Electronic Check is “Successfully Submitted” when in-app confirmation is received.
c. Availability Timing. If you submit before 7:00 p.m. Eastern on a business day, we treat it as submitted that day; otherwise, it’s the next business day. Business days exclude weekends and U.S. federal holidays. Subject to delays or holds, funds from Electronic Checks are generally available 1–15 business days after successful submission.
d. Returned or Claim Checks. We may make funds available before clearing from the paying bank. If the check fails to clear after availability, you must repay credited funds. If an Electronic Check is presented more than once, the paying bank may recover funds; we may deduct the amount from your Cashex Balance. Negative balances must be repaid immediately per Section XX.1.
8. Third-Party Rights
Mobile Check Capture is provided by Mitek Systems, Inc. (“Mitek”) as an “as is” service with no additional warranties. Mitek disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. Mitek is not liable for indirect, punitive, special, incidental, or consequential damages.
Mitek grants you a limited license to use Mobile Check Capture technology only as integrated with Cashex. You may not copy, distribute, modify, or sublicense Mitek’s technology outside Cashex. Unauthorized use is a material breach.
You agree we may share your information (personal or transactional) with Mitek as necessary to:
(i) review transactions for fraud,
(ii) confirm proper use per Mobile Check Capture terms,
(iii) improve Mobile Check Capture, including enhancing fraud detection.
XVI. Cashex Pay
1. Description of Cashex Pay
Cashex Pay allows you to use your Account as a payment method to buy goods, services, or make donations online, in-app, or in-person (“Cashex Pay”).
2. Using Cashex Pay at Approved Merchants
Cashex Pay can be used when you:
Visit an e-commerce app or website, select Cashex as payment method, and pay with your Account.
Scan a Cashex QR code at checkout with your Account on your phone.
In-store, scan a Cashex QR code generated by a point-of-sale device (e.g., Square POS) using your Account.
Only Company-approved merchants (“Merchants”) may accept Cashex Pay. We may revoke approval at any time without notice.
When you authorize a payment (“Payment”) using Cashex Pay, you authorize us to withdraw funds from your Cashex Balance or linked debit account (to the extent eligible and available). Until you have an Unrestricted Account, you cannot use Cashex Balance; payments will be funded by linked debit or rejected if identity is not verified. Some Merchants may accept only Cashex Balance payments; if your funding source lacks funds, the Payment may decline. If you make a Payment exceeding your Cashex Balance, you authorize us to charge your linked debit card for any shortfall. If your transaction amount increases (e.g., you add a tip or additional items), you authorize us to withdraw additional funds from a funding source; this may appear as a separate Payment.
A Payment may appear as pending while the Merchant completes the transaction; we may place a temporary hold on your Cashex Balance. If a debit card is used, your card issuer may show a pending authorization hold until the transaction completes. The final Payment amount may differ.
3. Limits on Cashex Pay
We may impose limits on transaction amounts or number of Payments via Cashex Pay. Limits may change at our discretion. We may decline or delay a Payment if (i) it may violate law, these Terms, or Cashex Pay terms, (ii) it exposes us to liability or risk, (iii) instructions or authorization are unclear, (iv) the debit card issuer prohibits it, (v) we suspect fraud or security risk, or (vi) as otherwise stated in these Terms. We are not responsible for losses due to our cancellation or delay of a Payment. If a debit card is used, additional issuer terms may apply.
4. Purchases via Cashex Pay
WE MAKE NO WARRANTIES REGARDING MERCHANTS, GOODS, OR SERVICES PURCHASED VIA CASHEX PAY. ALL IMPLIED WARRANTIES (MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT) ARE DISCLAIMED.
Purchases using Cashex Pay are subject to the Merchant’s refund or cancellation policy, not these Terms. For returns or cancellations, consult the Merchant’s policy. Refunds will not exceed the Payment amount; no cash refunds. If a transaction is refunded, funds return to you in your Cashex Balance or as determined by the Merchant. Transactions may not be refunded to the original funding source.
XVII. Concert Tickets & Event Booking
Cashex may offer ticket purchasing and event booking (“Ticket Services”) within the app for concerts, sports, theater, and other live events. Use of Ticket Services is subject to the following terms:
1. Purchasing Tickets
a. Availability & Pricing. Ticket availability and pricing are determined by third-party ticket vendors and event organizers. We act as an agent facilitating the purchase. Ticket prices may include service fees, convenience fees, and delivery charges, disclosed at checkout. Cashex is not liable for price errors, changes in seat assignments, or event cancellations. All sales are final unless otherwise stated.
b. Payment. Tickets can be purchased using your Cashex Balance, C$H (if supported by the vendor), or linked debit/credit card. Once payment is authorized and processed, your order is confirmed.
c. Delivery & Access. E-tickets are typically delivered via email or accessible in-app. Physical tickets, if offered, are shipped per vendor delivery timelines. You are responsible for providing accurate delivery information.
d. Resale & Transfers. Resale or transfer of purchased tickets is governed by vendor policies. Unauthorized resale or duplication of tickets may result in denial of entry and no refund.
2. Event Cancellation, Postponement, or Changes
If an event is canceled, postponed, or rescheduled, ticket refunds or exchanges are subject to the event organizer’s policy and vendor terms. Cashex will facilitate the refund per organizer instructions but is not responsible for event changes. Venue capacity restrictions, safety protocols, or force majeure events may result in ticket voiding or modified refunds.
3. User Obligations & Conduct
You agree not to reproduce, distribute, sell, or transfer tickets in violation of applicable laws or vendor terms. You will comply with venue rules, event policies, and all applicable laws. Cashex may revoke your ticket privileges if you violate these terms or vendor policies.
4. Limitation of Liability
Cashex is not responsible for event quality, seating assignments, weather-related cancellations, or any other circumstances causing you to be unable to attend an event. Cashex’s sole responsibility is facilitating payment and forwarding purchase details to the vendor.
XVIII. Hotel Booking
Cashex may offer hotel booking services (“Hotel Services”) within the app. Use of Hotel Services is subject to the following terms:
1. Availability & Pricing
Room availability, rates, taxes, and fees are determined by third-party hotel vendors. Cashex acts as an agent for booking. Prices may fluctuate based on availability and demand and may include resort fees, service charges, or local taxes, disclosed at checkout. Cashex is not liable for price errors or changes in room inventory.
2. Payment & Confirmation
You can book rooms using Cashex Balance, C$H (if supported), or a linked debit/credit card. Once payment is processed, you receive a booking confirmation via email or in-app.
3. Cancellations & Modifications
Hotel cancellations, modifications, and no-show policies are governed by the hotel’s terms. You are responsible for understanding and complying with those policies, including potential fees or penalties. Cashex may facilitate refunds or changes but is not responsible for hotel policy enforcement.
4. Guest Obligations & Conduct
You agree to comply with hotel rules, check-in/check-out times, and all applicable laws. You are responsible for any incidental charges incurred during your stay (e.g., room service, minibar, damage fees). Violating hotel policies may result in additional fees or eviction without refund.
5. Limitation of Liability
Cashex is not responsible for hotel accommodations, staffing, amenities, or conditions. Our responsibility is limited to facilitating booking and payment. Any disputes regarding hotel services must be resolved directly with the hotel.
XIX. Promotions
Cashex may run promotions, contests, sweepstakes, or special offers (“Promotions”) from time to time. Each Promotion has specific terms, conditions, and eligibility criteria posted alongside the Promotion details.
1. Eligibility & Participation
Promotions may be limited to certain geographies, age groups, or Cashex Account statuses. Unless otherwise specified, Promotions are open only to individuals with a valid Cashex Account in good standing. Employees, contractors, or family members of Cashex Global Inc. are typically ineligible. Specific eligibility rules are posted with each Promotion.
2. Entry & Requirements
Promotion entry methods, deadlines, and requirements vary. You must follow instructions exactly to be eligible. Entries must be submitted by the deadline; late or incomplete entries are disqualified. By entering, you agree to abide by Promotion rules and decisions of Cashex, which are final.
3. Prizes & Fulfillment
Prizes, if any, are awarded per the Promotion’s official rules. Winners are responsible for applicable taxes and fees. Prizes are non-transferable unless otherwise specified. If a prize becomes unavailable, we may substitute with a prize of equal or greater value.
4. Publicity & Privacy
Unless prohibited by law, winners may be required to participate in promotional activities (e.g., publicity, social media posts) without additional compensation. By entering, you consent to our use of your name, likeness, and Entry content for promotional purposes.
5. Limitation of Liability
Cashex is not responsible for any technical failures, lost entries, or delays. In no event shall Cashex be liable for any damages arising from Promotions beyond the prize value.
XX. Other Legal Terms
1. Recovery of Funds
You authorize the Company to recover amounts you owe by debiting funds from your Cashex Balance, any linked Account, or any other account you hold with the Company. This includes amounts owed due to negative balances, fraud, or other reasons. We may recover all or part of amounts owed without prior notice and irrespective of demand, and in compliance with network and NACHA rules. If recovery attempts fail, we may contact you or pursue legal action to collect owed amounts.
We may also recover funds in connection with a disputed transaction. For example:
• If a Cashex user claims a payment you received was invalid and requests reimbursement, we may recover that amount from your Cashex Balance and/or Savings Balance.
• If you dispute a transaction with an external funding source and win, we may recover funds from your Account.
If there are insufficient funds, your Account may go negative; we may recover funds to zero per these Terms. We are not liable for recovering funds to cover negative balances, owed amounts under these Terms, pending disputes, or to protect against financial risk.
2. Compliance with Governmental Authorities
We may freeze, withhold, or remit funds in your Account in response to subpoenas, court orders, tax levies, garnishments, liens, or other binding orders from governmental authorities or third parties.
3. Limitations on Use
a. Funding Source Restrictions. We may limit which funding sources are available for specific transactions at our discretion. You may not use prepaid or gift cards from unaffiliated issuers to fund Cashex transactions.
b. Legal Compliance. You are independently responsible for complying with all applicable laws in your use of the Service. You agree to be bound by NACHA rules.
c. Prohibited Uses. You agree not to:
Use your Account or the Service in a manner that Cashex, Visa, MasterCard, American Express, or Discover reasonably believe to be an abuse of the payment system or violation of payment network rules.
Provide yourself a cash advance from a credit account or help others do so.
Use the Service solely to earn rewards, perks, miles, or points on a credit account.
Use the Service for illegal activities or to facilitate wrongdoing.
Use the Service in violation of sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC)—including, but not limited to, activities involving Iran, Cuba, North Korea, Syria, or the Crimea region of Ukraine.
Access or monitor any Cashex system using automated means (robots, spiders, scrapers).
Violate any robot exclusion headers or circumvent technical limitations of the Service.
Perform actions that interfere with the Service’s proper operation, prevent others from using the Service, or impose an unreasonable load on infrastructure.
Copy, reproduce, modify, publicly display, republish, upload, post, transmit, resell, or distribute Cashex materials or information.
Transfer any rights granted under these Terms.
Use the Service for the sale of firearms, ammunition, weapons, or other harmful devices.
Engage in any conduct that could harm Cashex, its partners, or other users.
If we reasonably suspect your Account is being used for unauthorized, illegal, or criminal purposes, you authorize us, subject to applicable law, to share information about you, your Account, and transactions with law enforcement.
4. Acceptable Use Policy & Other Restrictions
Your use of Cashex and the Services is subject to Cashex’s Acceptable Use Policy. You may not, directly or indirectly, engage in any activity that:
• Violates U.S. OFAC sanctions (e.g., transactions involving prohibited jurisdictions, entities, or individuals).
• Interferes with or disrupts Cashex’s operation (e.g., unauthorized access, hacking).
• Violates robot exclusion guidelines or bypasses Service controls.
• Infringes third-party intellectual property rights.
• Facilitates illegal conduct or fraud.
• Otherwise conflicts with these Terms.
Cashex may block, refuse, or reverse any transaction in its sole discretion. Notification is not required if prohibited by these Terms or law. Neither Cashex nor any third party processing provider is liable for prohibited transactions. Research and resolution costs for misapplied, misposted, or misdirected prohibited transactions are your responsibility.
5. Limitations on Our Liability for Failure to Complete Transactions
Subject to applicable law, we are not liable for failure to complete transactions if:
(a) You have insufficient funds in your Cashex Account or funding source.
(b) A merchant refuses to accept a Cashex Card (when available).
(c) You provide incorrect, incomplete, or ambiguous information.
(d) An ATM or POS terminal does not have enough funds or malfunctions.
(e) Your Cashex Card is lost, stolen, or damaged.
(f) Your funds are blocked due to legal or administrative reasons.
(g) We suspect the transaction is unauthorized.
(h) Circumstances beyond our control prevent completion (e.g., fire, flood, power failure, strike, system outage, government action, natural disaster).
6. Changes to External Account Numbers
If your linked Credit Account or debit card number changes (e.g., new expiration date), we may obtain updated information from our partners and update your Account accordingly.
7. Our Relationship With You
We are an independent contractor except that we act as your limited agent regarding custody and transfer of funds for the Services.
8. Termination of Account
We may terminate these Terms or any Service, or suspend or terminate your Account (and any associated Sponsored Accounts), at any time for any reason, including violation of these Terms. We may add, remove, suspend, or impose conditions on Services or features. We will take reasonable steps to notify you of termination or changes via email or in-app when you next attempt to access your Account. You may also deactivate your Account at any time.
9. Effect of Termination
If these Terms or your Account is terminated or suspended:
(a) All licenses and rights granted under these Terms end.
(b) We may delete your information and account data from our servers.
(c) We are not liable for any compensation, reimbursement, or damages due to termination or data deletion.
Surviving Provisions: Upon termination, the following Sections remain in effect: V.1 (Your Content), V.4 (Ownership), V.6 (Copyright & Trademark Infringement), XX.9 (Effect of Termination), XX.14 (Indemnity), XX.15 (No Warranties), XX.16 (Limitation of Liability), XX.17 (Third-Party Products), XX.18 (Disputes), XX.19 (Binding Arbitration), XX.20 (Governing Law), XX.21 (Assignment), and XX.22 (Other Provisions).
10. Services Upon Closure of Account
Upon termination, any pending transactions will be settled. Remaining funds held in custody, less fees, may be made available for you to withdraw at our discretion and subject to these Terms. We may require you to link a new bank account not previously associated with your Account to withdraw funds. We may hold your funds to protect against reversals, chargebacks, claims, fees, fines, or penalties. If an investigation is pending, we may hold funds until resolution.
11. Unclaimed Property
If your Account is inactive for an extended period, it may be deemed “unclaimed” or “abandoned” under state law. We will provide notice as required by law. If funds remain, we will escheat them as required.
12. Referral Programs
We may offer referral programs or incentives to invite others to use the Service (“Referral Program”). Bonuses or incentives are subject to Program terms and our discretion.
13. Taxes
You are responsible for all taxes resulting from your use of the Service, except those we voluntarily absorb. All payments by you to the Company are made free and clear of any deductions or withholdings. Any required government withholdings are your responsibility.
Remittance transfers may be subject to taxes under law, reducing the amount received by the recipient or charged to you. We disclaim liability for such taxes.
You may be asked to provide information to help the Company comply with U.S. tax laws. By providing information, you certify it is accurate and consent to our use for tax filing or withholding purposes.
When specifying a Business Account, you certify your use of Cashex is to receive “reportable payment transactions”—payments for goods and services as defined in Treas. Reg. § 1.6050W-1(a)(3). When using Peer-to-Peer for “Personal” transfers, you certify such uses are not for reportable payment transactions.
For West Virginia Residents: Where applicable, West Virginia sales tax is paid on your behalf for certain fees.
14. Indemnity
You will defend, indemnify, and hold us and our processors (and our employees, directors, agents, affiliates, and representatives) harmless from all claims, costs, losses, damages, judgments, tax assessments, penalties, interest, and expenses (including reasonable attorneys’ fees) arising from or related to:
(a) Your breach of representations, warranties, or obligations in these Terms;
(b) Your wrongful or improper use of the Services;
(c) Your violation of any third-party right (privacy, publicity, IP);
(d) Your violation of any law, U.S. or international;
(e) Third-party claims regarding our processing of personal information;
(f) Any other party’s access/use of the Services with your credentials.
15. No Warranties
THE SERVICES ARE PROVIDED “AS IS” WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will:
• Meet your requirements.
• Be available at any particular time or location, uninterrupted, error-free, without defect or secure.
• Be free of viruses or other harmful components.
We make no warranties regarding third-party products or services accessed through the Services and are not responsible for any defects or issues with third-party products.
16. Limitation of Liability and Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING FROM USE OF, INABILITY TO USE, OR UNAVAILABILITY OF THE SERVICE. WE WILL NOT BE LIABLE FOR DAMAGES THAT ARE NOT REASONABLY FORESEEABLE.
THE COMPANY’S TOTAL LIABILITY IS LIMITED TO THE GREATER OF (A) FEES EARNED BY US IN CONNECTION WITH YOUR USE OF THE SERVICES IN THE THREE (3) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $500. THIS LIMIT APPLIES REGARDLESS OF WHETHER LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL THEORY, EVEN IF ADVISED OF POSSIBILITY OF SUCH DAMAGES.
THE COMPANY IS NOT RESPONSIBLE FOR HACKING, TAMPERING, OR UNAUTHORIZED ACCESS TO THE SERVICES OR YOUR ACCOUNT.
17. Third-Party Products
Third-party products included or sold with the Services are provided under the third party’s warranty and terms. For service, support, or warranty issues, contact the manufacturer. THE COMPANY DISCLAIMS ALL WARRANTIES FOR THIRD-PARTY PRODUCTS, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
18. Disputes
“Disputes” (for Section XX.19) means any claim, controversy, or dispute between you and the Company (including processors, suppliers, licensors, affiliates, directors, or employees), whether arising before or during these Terms, including any claim related to these Terms or Services, or any conduct before these Terms.
19. Binding Arbitration
For Individual Cashex Customers:
General. Except for informal resolution or small claims court, all Disputes will be resolved by binding individual arbitration with a neutral arbitrator (“Arbitrator”) administered by National Arbitration and Mediation (“NAM”) per NAM’s Comprehensive Rules and Procedures and Supplemental Rules for Mass Arbitration Filings (together, “NAM Rules”), and this section. ANY ARBITRATION WILL BE ON AN INDIVIDUAL BASIS; CLASS, REPRESENTATIVE, MASS, OR CONSOLIDATED ACTIONS ARE NOT PERMITTED. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Nothing prevents settlement of Disputes on a class, representative, or consolidated basis if both parties agree. If any provision of this arbitration agreement is found unenforceable, it will be severed, and remaining terms enforced, but class or consolidated arbitration remains prohibited. The Arbitrator decides threshold arbitrability issues (e.g., whether these Terms are enforceable).
Pre-Filing Requirement. Before arbitration or lawsuit, you and Cashex agree to attempt to resolve Disputes informally. You must send a written Notice to Cashex (Cashex Global Inc., Attn: Arbitration Agreement, 1955 Broadway, Suite 600, Oakland, CA 94612) and personally meet and confer via phone or video for at least 60 days from the date Notice is received. The Notice must include:
Your name, mailing address, CashID, email, phone number;
Detailed information to evaluate claim merit and potential resolution;
Specific relief sought and good-faith calculation of amount in controversy in USD;
Your personal signature (or the Company’s).
A Notice is only valid for an individual party; group Notices are invalid. After the 60-day informal resolution period and required conference, either party may send a written Notice electing arbitration or small claims court. The recipient then has seven (7) days to respond and elect small claims court. If not responding or electing small claims court, arbitration may commence. Failure to follow informal resolution is a condition precedent to arbitration or small claims; failure allows the other party to seek dismissal and cost reimbursement. Either party may seek injunctive relief in California state or federal court to enforce pre-filing requirements or determine if claims are barred.
Small Claims Court. You or Cashex may elect to pursue a Dispute in small claims court (jurisdictional limits apply) rather than arbitration, provided the dispute stays in small claims and proceeds individually. If arbitration demand is filed but no Arbitrator selected, and the claim fits local small claims jurisdiction, the other party may request small claims resolution. If so, and all arbitration fees are paid, the arbitration provider will administratively close the case.
Arbitration Procedures. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs. The arbitration is by submission of documents to one Arbitrator. If a hearing is required, it will be remote (phone or video). If an in-person hearing is required, it will be near your hometown. Both parties can file early or summary dispositive motions. The Arbitrator’s award is binding and may be entered as a court judgment. The arbitration is confidential; neither party may disclose its existence or outcome without written consent, except to enforce or challenge the award or as required by law. The Arbitrator may award individual declaratory or injunctive relief only if necessary to provide relief for that party’s claim. The Arbitrator’s decision will not have precedential effect in other disputes.
Bellwether Arbitration Procedures. If 25 or more similar individual arbitration demands are filed by or with coordinated counsel (“Mass Proceeding”), the parties will select 12 individual demands (6 per side) for “Bellwether Arbitration.” The arbitration provider decides if demands constitute a Mass Proceeding; any party may request appointment of a Procedural Arbitrator to address initial issues (e.g., whether Bellwether procedures apply, whether specific demands belong). Bellwether Arbitrations must be completed within 120 days of pre-hearing conference. While Bellwether Arbitrations proceed, remaining demands are held in abeyance with fees deferred (except initial filing and Procedural Arbitrator fees). Tolling of any statute of limitations begins when Notice to initiate informal resolution is sent.
After Bellwether Arbitrations, parties engage in a Bellwether Mediation administered by the arbitration provider. If unresolved within 30 days, remaining Mass Proceeding demands proceed individually per provider rules. Parties must cooperate with the provider to implement Bellwether procedures and consider steps (e.g., discovery special master, expedited calendar) to minimize time and costs. Bellwether procedures do not authorize class or joint arbitration.
Arbitration Fees. The initiating party pays applicable arbitration filing fees per NAM Rules. References to you and Cashex include affiliates, agents, and successors. Cashex values your privacy; arbitration is confidential.
Opt-Out. To reject arbitration, send an opt-out notice within 30 days of first creating a Cashex Account (or, for existing customers, within 30 days of agreeing to updated terms) to Cashex Global Inc., Attn: Arbitration Agreement, 1955 Broadway, Suite 600, Oakland, CA 94612. Provide your name, address, CashID, phone number, and email used for Cashex. This is the only way to opt out. Opting out does not affect other Terms or future arbitration agreements. Any opt-out letter purporting to opt out multiple parties is invalid; one opt-out per party is allowed.
Court Proceedings. Subject to and without waiving arbitration, you agree that any judicial proceedings (other than small claims) will be in California state courts (City of Oakland, Alameda County) or U.S. District Court for the Northern District of California. You consent to jurisdiction and venue there.
For Cashex for Business Customers:
The same arbitration terms apply, except:
• You acknowledge you do not use the Service for personal, family, or household purposes; you are not a “consumer.” For arbitration fees, NAM’s Comprehensive Fees schedule applies.
20. Governing Law
These Cashex Terms and any Dispute will be governed by the Federal Arbitration Act (for arbitrable Disputes) and by California law (without regard to choice of law or conflicts rules) for non-arbitrable matters.
21. Assignment
You may not assign or transfer any rights under these Terms; any attempted assignment is void. We may assign these Terms to affiliates or in connection with a merger or acquisition.
22. Other Provisions
These Cashex Terms (plus any Policies) constitute the entire agreement between you and Cashex regarding the Services. In case of conflict, these Cashex Terms prevail. If any provision is invalid or unenforceable under applicable law, it will be modified to achieve its intent to the greatest extent possible, and the remaining provisions will continue in full force. These Terms do not limit our rights under trade secret, copyright, patent, or other laws. No waiver of any term is a continuing waiver of that term or any other.

These Additional Cash Terms of Service (the “CashTerms”) govern your use of the CashMe application, and the website at cash.me(the “Cash Site”), and the electronic money and payment services provided toyou through the Cash Site and CashMe (the “CashMe Service”).
The CashMe Service is provided by Cash, Inc, a company incorporated in Delaware, United States company number08957689, whose head office is at 447 Broadway, New York, NY, 10013, United States.
Cash, Limited, a company incorporated in England and Wales with company number583287 whose registered office is at Fumbally Cash, Inc, Fumbally Lane, Dublin8, Ireland (‘Cash, Inc International’ and together with Cash, Inc Europe, “Cash,Inc” “we,” “our,” or “us”), provides all other services, including the SaaSServices (as defined in the Point-of-Sale, Saas, andService Terms) (the “SaaS Terms”) related to the CashMe Service.
By using the CashMe Service, you agree to be bound by these Cash Terms, the SaaS Terms and the General Terms (collectively, the “Service Terms”), and acknowledge that they constitute a legally binding contract between us and you. Defined terms have the same meaning as those found in the General Terms, unless otherwise defined herein. To the extent there is any inconsistency between these Cash Terms and any other terms applicable tot he CashMe Service, these Cash Terms shall prevail. If you do not agree to allof these terms, you are not permitted to access or use the CashMe Service, andyou should not proceed further.

I. Ourstatus
Cash, Inc is an Electronic Money Institution authorised by the Financial Conduct Authority (the “FCA”) under the Electronic Money Regulations 2011 (firm reference number900846) for the issue of electronic money and provision of payment services.Details of our authorisation are available on the public register https://register.fca.org.uk/.
II.Overview of the CashMe Service
The CashMe Service enables you to store funds in your Cash Balance and to transmit or receive payments with other CashMe customers. You can make payments from the funds you hold in your (i) CashBalance (ii) your linked U.K. bank account (your “Bank Account”), or (iii) your linked U.K. debit card (“Debit Card” and each, an “Eligible Debit Account”).You can also receive payments into your your Eligible Debit Account.
III.Eligibility
You must be a resident of the United Kingdom and at least 18 years of age to use the CashMe Service and you must register for an account (your “Cash Account”). You must only create a Cash Account with an tomwildgust1@gmail.com address or a mobile telephone number that you own.
IV. CashAccount
In order to use the CashMe Service you must create an account by providing us with certain information (your “Cash AccountInformation”). You represent and warrant that any information you enter in yourCash Account is true and accurate. It is your responsibility to regularly checkyour Cash Account Information and to ensure that all of your Cash AccountInformation is up to date and accurate at all times.
We may request that you provide us with certaininformation, including but not limited to your name, email address,text-enabled mobile telephone number, street address, postcode, date of birth,and a government issued form of identification. You acknowledge and understandthat, directly or through third parties, we may make any inquiries we considernecessary to validate and authenticate your identity and Cash AccountInformation. This may include asking you for further information anddocumentation about your usage of the CashMe Service or identity, or requiringyou to take steps to confirm ownership of your email address, mobile telephonenumber or Eligible Debit Account, and verifying your information against thirdparty databases or through other sources.
The first time you access your Cash Account using anew device we may require you to authenticate your Cash Account with additionalinformation. If your Cash Account cannot be verified you may be required to setup a new account.
You authorise Cash, Inc International, in order toprovide you with the CashMe Service, including the SaaS Services, to view,monitor and analyse all activity in your Cash Account and to track, predict,report on and monitor fraud and other suspicious or financially risky activity.You further authorise Cash, Inc International to investigate any potentialfraud, suspicious or financially risky activity, as it may deem appropriatetaking into account Applicable Law. Your authorisations permit Cash, IncInternational to: report to you on Cash, Inc Europe transferring funds for thepurpose of reversing transactions; assess the onboarding, transactional andrelated data in your Cash Account and request additional information andconfirmations from you; assess your transaction history for root cause orsystemic issues with a view to suggesting to you appropriate preventativemeasures for fraud and suspicious activity; and conduct investigations andresolve any pending disputes related to your use of the CashMe Service.
Where Cash, Inc International’s analysis of yourCash Account indicates that there is an undue likelihood of fraud, suspiciousactivity or financially risky behaviour occurring that can be eliminated,reduced or prevented by taking any action permitted hereunder (including butnot limited to suspending or declining Payments), you further authorise Cash,Inc International to recommend that Cash, Inc Europe implement such action inorder to mitigate such likelihood.
If you refuse to (a) cooperate in an investigation(b) provide confirmation of your identity or, (c) provide confirmation of anyinformation you provide us, then we may close, or refuse to open, your CashAccount.
V. CashIDs
You may select a unique alpha-numeric name toidentify yourself for the purposes of using the CashMe Service (a “CashID”).Your CashID must accurately and truthfully represent your personal identity.You may not select a CashID that misleads or deceives others as to youridentity or creates an undue risk of mistaken payments. We may require you tochange your CashID or details of your profile in our sole discretion, and wemay reclaim or make unavailable CashIDs without liability to you.
VI. AccountStatements
All of your CashMe Service transactions arerecorded and can be accessed in your “Transaction History” portion of the CashMeor on the Cash Site. You agree that we will provide you with a monthly accountstatement through the CashMe and the Cash Site. You are able to download orprint your monthly account statement to retain permanently and we advise thatyou do so. You should monitor your Transaction History on a regular basis andnotify us of any transaction activity you do not recognize by contactinghttps://cashme.com/help.
You should ensure your device and software is up todate to ensure that you can access your monthly account statements through CashMeor on the Cash Site.
VII.Communication
We will provide communications to you (1) throughthe notification channel you choose in your CashMe profile, (2) by making themavailable in CashMe, or (3) on the Cash Site.
You may opt out of receiving promotional messagesfrom CashMe at the time you set up your Cash Account by visiting the“Notifications” section of your profile in CashMe or on the Cash Site or byfollowing the instructions in those messages as set out in the privacy policy.If you opt-out of receiving such promotional communications we will still sendyou messages about your use and our provision of the CashMe Service.
Depending on the information you provide us, andyour settings at the “Notifications” sections of CashMe or on the Cash Site wemay send you CashMe Service related and promotional communications (if you havenot opted out) via email, text (SMS) or via CashMe.
If you provide us with the email address, CashID ormobile number of any other person when initiating or requesting a paymentthrough the CashMe Service, we will contact that person via email address, text(SMS) message or via CashMe person to notify the other person of your requestto make such payment.
Standard text messaging rates may apply based onyour plan with your mobile phone carrier.
VIII. CashSupport
If you needto contact us or make any notifications to us in connection with the CashMeService or under these Cash Terms, you should contact Cash Support at https://cashme.com/help.
IX.Security Credentials
Upon registration for a Cash Account, you have anoption to go to your settings within the CashMe and enable touch ID and upondoing so you will be prompted to set a four (4) digit personal identificationnumber “PIN”, and for devices that do not have touch ID functionality, onlysetting a PIN (each a “Security Credential”). Once you enable your SecurityCredential you will then be prompted to use a Security Credential each time youattempt to transfer funds.
In the event that you attempt to log in to yourCash Account from a new device, we will prompt you to enter your PIN to accessyour Cash Account from such new device.
You must take all reasonable steps to keep your Security Credentials, and any device on which the CashMe is installed, secure at all times and you must not share your Security Credentials or device with any third party. You should note that your obligations under this Section have a direct impact on Cash, Inc Europe’s responsibility to reimburse you for unauthorised payment transactions in accordance with Section XIII(3) of these Cash Terms.
X.Compromised, or Threat of Compromised, Accounts
If you become aware of or suspect: (i) any loss, theft or compromise of your Security Credentials or any device paired to yourCash Account or (ii) any unauthorised use of your Security Credentials or CashAccount, you must notify Cash, Inc Support immediately by contacting us athttps://cashme.com/help. You should note that your obligations under thisSection have a direct impact on our responsibility to reimburse you for unauthorised payment transactions in accordance with Section XIII(3) of theseCash Terms.
If you notify us of a security concern regarding your Cash Account, or if Cash, Inc has grounds to suspect a fraud or security threat to your Cash Account, we will contact you using the designated email or mobile number registered to your Cash Account. In such communication we will provide you with a link to our support center, which will require that you provide your Security Credentials for access, and through this secureconnection we will provide you with further information about the suspectedfraud or security threat to your Cash Account. You should contact usimmediately if we contact you about suspected fraud or security threat as wemay suspend your Cash Account until the issue is resolved. Please note, incommunications with you, Cash Support staff may ask you security relatedquestions in order to verify that you are the registered owner of the CashAccount. Cash Support staff will not however ask you to reveal remote accesslog-on information and you should keep this confidential and secure. Due to ourlegal obligations, we may need to verify certain facts before we are able to discussa suspected fraud or security issue openly with you. We recommend that you keepaccess to your designated email or data sent to your mobile phone numberpersonal to you and secure.
If you have informed us of a security breach inrelation to, or if we otherwise suspect the fraudulent or unauthorised use of,your Cash Account, we may suspend further use of your Cash Account inaccordance with this Section and we require you to change your SecurityCredentials.
We will inform you of any intention to suspend theuse of your Cash Account, specifying the reasons for doing so, unless theprovision of this information would compromise reasonable security measures orwould otherwise be unlawful. Where it is not possible to notify you beforehand,we will do so immediately after suspending the use of your Cash Account. Wewill allow the use of your Cash Account as soon as practicable after the reasonfor stopping its use ceases to exist.
XI. CashBalance
**1. Funding your Cash Balance
Payments you receive from other CashMe customerswill be held in your Cash Balance. You can also transfer funds into your CashBalance using your linked debit card or bank account.
**2. No Interest
You will not receive interest on or other monetarybenefit related to the length of time during which we hold your funds in theCash Balance. Your Cash Balance is not a deposit and you do not have any rightto seek compensation under the UK’s Financial Services Compensation Scheme ifyou suffer any financial loss of the Cash Balance.
**3. Transferring Money from your Cash Balance toYour External Account
**i. Generally
You may transfer funds from your CashMe to yourBank Account. You can choose to transfer funds using the standard transfer orthe “Instant Deposit” (if Instant Deposit is available to you). With a standardtransfer the deposit will be made available to you by the end of the nextBusiness Day. For the purpose of these Cash Terms, “Business Day” means a dayother than a Saturday, Sunday or a public holiday in England when banks inLondon are open for business.)
Instant Deposits will be transferred to your BankAccount within thirty (30) minutes. Instant Deposits are subject to the feelisted in the CashMe during the Instant Deposit experience. We reserve theright to delay transfers if we consider it necessary for security or anti-moneylaundering purposes or in order to comply with Applicable Law. We may requestthat you provide additional information to verify your identity beforecompleting the transfer.
**ii. Limitations
You may not transfer funds from your CashMe to yourBank Account to evade an investigation. If you attempt to transfer funds fromyour Cash Balance while we are conducting an investigation, we may hold yourfunds for up to 180 days to protect Cash, Inc or a third party against the riskof reversals, chargebacks, claims, fees, fines, penalties and other liability.You will remain liable for all obligations related to your account even afterthe account is closed.
**4. Making Payments Using Funds in Cash Balance
You can transfer funds to another CashMe customerin accordance with Section XII below. If you have insufficient funds in yourCash Balance to cover the entirety of the amount to be transferred we will pullthe full transaction amount from your Bank Account or Debit Card.
**5. Limitations
Cash, Inc may limit the payment methods that youcan use to load your Cash Balance.
We may impose limitations on the amount you canhold in your Cash Balance and the maximum amount or frequency with which youload funds into your Cash Balance.
XII. MakingPayments
1. General
You may transmit funds or receive funds using the CashMeService for personal, non-commercial purposes. If you attempt to transmit fundsto an individual who does not have a Cash Account, we will contact thatindividual using the contact details provided by you and we will invite them tocreate a Cash Account as set out in Section XII(2) below.
2. SendingMoney
Once you have registered for a Cash Account and (i)have funds available into your Cash Balance; or (ii) linked Bank Account orDebit Card, you will be able to initiate fund transfers. As a party initiatinga transfer (“Sender”), you can transfer funds to your selected recipient(“Recipient”) by (i) logging into your Cash Account, (ii) designating theRecipient by entering their CashID, email or phone number, (iii) indicating theamount of money you want to send, and (iv) selecting the confirmation action (a“Payment Instruction”). Once you have confirmed the Payment Instruction, youauthorise us to debit funds from your Eligible Debit Account and transfer themto the designated Recipient (a “Payment”). By submitting a Payment Instruction,you are also authorising us to move the funds back to your Eligible DebitAccount for Payments that are cancelled or otherwise returned (a “Credit”).
You cannot revoke a Payment Instruction once it hasbeen received by us. You understand and agree that when you initiate a PaymentInstruction the funds will be deducted from your Cash Balance on the same dayas we receive your Payment Instruction. However, the Recipient will only beable to receive the transferred funds once they have registered for a CashAccount. You hereby authorise and direct us to retain such funds until theearlier of: (i) such time as the Recipient has successfully registered for a CashAccount or (ii) fifteen (15) days. If the Recipient has not registered for aCash Account you are permitted to cancel the order at any time, and if you donot and the Recipient has not registered for a Cash Account within fifteen (15)days, we will return the funds to you. If we are not able to return funds toyour Eligible Debit Account, we may use other reasonable means to return thePayment to you, as permitted by Applicable Law.
You agree that we shall incur no liability if weare unable to complete any transaction because of: (i) insufficient funds inyour Eligible Debit Account; (ii) malfunction of the CashMe Service due tocircumstances beyond our control or due to circumstances that you were alreadyaware of at the time you initiated your Payment Instruction; (iii) aninaccurate or insufficient Payment Instruction; or (iv) failure of theRecipient to claim the Payment.
3.Requesting Cash
You may also initiate a request for funds to betransferred to you by designating the amount of funds requested and yourselected Sender (a “Cash Request”). If the Sender approves your Cash Request,your Cash Request will become the Sender’s Payment Instruction and be processedas described in these Cash Terms.
4.Receiving Cash
You will receive payments made to you from otherCash customers into you Cash Balance. You can store the funds received intoyour Cash Balance to use for future payments or you can transfer the funds toyour Bank Account in accordance with Section XI.1(c).
5. InvalidPayments
If you receive a Payment and we later determine inour sole discretion that the Payment was invalid for any reason and should bereversed, then you authorise us to deduct funds held in your Eligible DebitAccount for an amount equal to the Payment.
6.Limitations on Use
You agree that you are independently responsiblefor complying with all Applicable Laws in all of your activities related toyour use of the CashMe Service, and for all communications you send through theCashMe Service.
As an electronic money institution we are requiredto mitigate the risks that your Cash Account would be used for financial crime,money laundering or other unlawful purposes. As such, Cash, Inc Europe reservesthe right to Cash, Inc, refuse, or reverse any Payment Instruction made underthese terms where it reasonably believes, including upon the recommendation of Cash,Inc International, that it must do so: (i) to protect the security of your CashAccount, (ii) if there is suspected unauthorised or fraudulent use of your CashAccount, (iii) you are in breach of the Service Terms or (iv) the transactionis or is determined by Cash, Inc Europe, in its sole discretion upon takinginto consideration any relevant recommendations from Cash, Inc International,likely to be unlawful. We will notify you promptly if we decide to do so,unless such notification would be unlawful.
Neither we nor third parties to whom we assign ordelegate rights or responsibilities will be liable for any claims or damagesresulting from Senders’ initiation of prohibited Payments. All costs for thefollowing will be your sole responsibility and not ours, which we reserve theright to charge at actual pass-through costs: (a) where you have indicated thewrong unique identifier (i.e. where you have provided us with the wrong CashID),and Cash, Inc must make reasonable efforts to recover the funds (b) in theevent we refuse a Payment Instruction as reasonably justified as a matter ofApplicable Law, and (c) in the event a customer revokes a payment order.
7. Limitson Payment Amounts
Additional identification information will berequired to send more than two hundred and fifty pounds (£250) in any onetransaction or in multiple transactions over any seven (7) day period or toreceive more than five hundred pounds (£500) in any seven (7) day period. Afterwe have verified your additional identification information, Senders may sendup to one thousand five hundred pounds (£1,500) in any one transaction or inmultiple transactions and Recipients may receive up to ten thousand pounds (£10,000)over any seven (7) day period. We may adjust these limits at any time in ourreasonable discretion for the purpose of mitigating the risk of financial crimeor fraud.
8. Fees
There are currently no fees for sending orreceiving money using the CashMe Service. If you choose to deposit funds toyour Bank Account using Instant Deposit, you will be charged the fee that isshown to your prior to your confirmation of the transaction.
XIII.Liability For Unauthorised or Incorrectly Executed Payment Transactions
1. Duty tonotify
We shallhave no liability for unauthorized or incorrectly authorized paymenttransactions made from your Cash Account that have not been authorised by youor have been incorrectly executed unless you notify us:(a) without undue delayon becoming aware of the unauthorised or incorrectly executed paymenttransaction; and (b) in any event, no later than 13 months after the date ofthe payment transaction. Such notifications should be made to Cash Supportat https://cashme.com/help.
2. Ourliability for unauthorised payment transactions
We will refund any unauthorized paymenttransactions made through your Cash Account provided you have notified us inaccordance with Section XIII(1) above and save to the extent you are liable forany part of the payment transaction as set out in the Section XIII(3) below.
3. Yourliability for unauthorised payment transactions
Unless you have acted fraudulently, you will haveno liability for a payment transaction not authorised by you after you havemade a notification under Section XIII(1) of these Cash Terms.
You will be liable for the first £35 of anyunauthorised payment transaction if it arises from the loss or theft of yourSecurity Credentials or the misappropriation of your Cash Account.
However, you will be liable for the entire amountof the unauthorised payment transaction if you have acted fraudulently or youhave intentionally or with gross negligence failed to: (a) use your CashAccount in accordance with these Cash Terms, (b) notified us under SectionXIII(1) of these Cash Terms of these terms; or (c) keep your SecurityCredentials safe.
4. Ourliability for incorrectly executed payment transactions
We will refund any payment transactions madethrough your Cash Account that have not been correctly executed provided youhave notified us of the incorrectly executed transaction in accordance withSection XIII(1). However, we will not be liable to you for an incorrectlyexecuted payment transaction when:
(a) we can demonstrate that the recipient hasreceived the transfer; or (b) the problem has arisen as a result of youproviding us with the incorrect information.
In the event of (b) above, we will make reasonableefforts to recover your funds. And regardless of liability under this Section,on request from you, we will immediately and without charge, make efforts totrace any non-executed or incorrectly executed transaction, and notify you ofthe outcome.
XIV.Privacy
We willonly use your personal information as set out in our Privacy Policy.
XV. Term,Amendment and Termination of Service
The Cash Terms are effective from the point youagree to these Cash Terms. The Cash Terms are conducted for an indefiniteperiod and will continue to apply until terminated by you or us in accordancewith these Cash Terms.
We may amend the Cash Terms from time to time byproviding you with two months’ notice of such changes before they come intoeffect. We will give you notice by providing you with a link to a copy of therevised Cash Terms in a form that you can save and print and will notify you ofthe proposed date of entry into force. You understand that you will be deemedto have accepted the changes to the Cash Terms unless you terminate your use ofthe CashMe Service and the Cash Terms before they come into force. If youreject any changes, you have the right to terminate free of charge and witheffect at any time until the date the changes would have applied.
You may close your Cash Account and terminate theCash Terms at any point in time for any reason by selecting that option withinyour Cash Account.
We reserve the right to terminate the Cash Terms orcease to provide CashMe Services to you either:
1. on two (2) months’ notice; or
2. with or without prior notice, if: (a) you no longersatisfy the eligibility criteria for the CashMe Service; or (b) we have reasonto believe you are using your Cash Account in connection with fraudulent orunlawful activities, money laundering or terrorist financing, or other criminalor illegal activity; (c) you have breached the Service Terms or any ApplicableLaw, or (d) we are required to do so by any competent court of law, governmentauthority, public agency or law enforcement agency.
Any termination of the Cash Terms or cessation of CashMe Services does not relieve you of obligations to pay Fees or costs accrued prior to the termination.
XVI.Complaints and Disputes
In the event of any dispute or problem with the CashMe Service please contact CashSupport at https://cashme.com/help inthe first instance. In the event that your query is not satisfactorilyresolved, you may lodge a complaint with us or request details about ourcomplaint handling procedures by following the instructions on the CashMe Site or contact support at https://cashme.com/help.
The Financial Ombudsman Service is an independentbody that helps settle complaints between customers and firms regulated by theFCA. If we are unable to resolve your complaint satisfactorily you may qualifyto escalate your complaint to the Financial Ombudsman Service by post,addressing your complaint to the Financial Ombudsman Service, Exchange Tower,London E14 9SR, by email to complaint.info@financial-ombudsman.org.uk or bytelephone on 0300 123 9 123 or 0800 023 4567. Financial Ombudsman Service’s websiteis http://www.financial-ombudsman.org.uk. Further information regarding theFinancial Ombudsman Service and whether you qualify for this service isavailable on the Financial Ombudsman Service’s website or can be requested bycontacting Cash, Inc Support. In addition, please note that disputes may besubmitted for online resolution to the European Commission Online DisputeResolution platform.
These Cash Terms shall be governed by English law,except that if you live in Scotland or Northern Ireland, there may be certainmandatory Applicable Laws of your country which apply for your benefit andprotection in addition to or instead of certain provisions of English law.
Any claims arising out of or relating to the CashTerms or the provision of the CashMe Service that cannot be resolved by contacting Cash Support may be settled through the Financial Ombudsman Service.In the event that you are not eligible or do not elect to make a complaint to the Financial Ombudsman Service, you agree that any dispute between you and us regarding these Cash Terms or the CashMe Service will only be dealt with by theEnglish courts, except that if you live in Scotland or Northern Ireland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.
XVII. OTHERLEGAL TERMS
1.Intellectual Property Rights
We license, but do not sell, to you the CashMe. We remain the owner of CashMe at all times.
All intellectual property rights in the Cash Site and CashMe and in any content of the Cash Site and CashMe (including text,graphics, software, photographs and other images, videos, sound, trademarks andlogos), are owned by us or our licensors. Except as expressly set out here,nothing in these terms gives you any rights in respect of any intellectualproperty owned by us or our licensors and you acknowledge that you do notacquire any ownership rights by downloading CashMe or any content from the CashSite or CashMe.
2. ReferralPrograms
From time to time, Cash, Inc International mayoffer referral programs or incentives for inviting others to use the CashMeService (a “Referral Program”). Any bonuses or incentives under such ReferralProgram shall be subject to the then current Referral Program terms, ifapplicable, and otherwise at our sole discretion.
3.Limitations.
We may impose limitations on the value andfrequency of payments that you can make using the CashMe Service. We reservethe right to change the limitation at any time for security reasons or where weconsider it necessary to comply with Applicable Law. We reserve the right torefuse any request to transfer funds if processing the transfer will exceedthese limits. Each funding source will have different dispute resolution rightsand procedures in the event your transaction turns out to be unsatisfactory.Your dispute resolution rights are determined by the funding source used tofund your transaction
4. Taxes
As a Recipient, you may be asked to provide certaininformation used to assist us in complying with certain U.K. tax reporting /disclosure obligations, as may be required. Also, you are responsible for an ytaxes which may be applicable to your use of the CashMe Service, and it is your responsibility to collect, report and pay the correct tax to the relevant tax authority.
5. Language
These Cash Terms and all information we provide to you in connection with the CashMe Service will be in English.
6. CashMeand Cash Site features and Content
You agree that access and use of the Cash Site anddownloading, access and use of CashMe, since they are made available free ofcharge, are on an ‘as is’ and ‘as available’ basis and at your sole risk.
We reserve the right to change the format andfeatures of CashMe and the Cash Site by updating the Cash Site and making theupdated CashMe available for you to download and, where your device settingspermit it, by automatic delivery of updates to CashMe. You are not obliged todownload updated versions of CashMe, but we may cease to provide and updatecontent to prior versions of CashMe and, depending on the nature of the update,in some circumstances you may not be able to continue using CashMe until youhave downloaded the updated version.
Where we make content available through the CashSite or CashMe, you acknowledge that such content may be updated at any time.We reserve the right to cease to provide and update content to the Cash Siteand CashMe, with or without notice to you, if we need to do so for security,legal or any other reasons.
Except as set out in these terms, we make or giveno representation or warranty as to the accuracy, completeness, currency,correctness, reliability, integrity, quality, fitness for purpose ororiginality of any content of CashMe and the Cash Site and, to the fullestextent permitted by law, all implied warranties, conditions or other terms ofany kind are hereby excluded and we accept no liability for any loss or damageof any kind incurred as a result of you or anyone else relying on the contentof CashMe and the Cash Site.
6. GeneralProvisions
These Cash Terms are between you and us. No otherperson shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operatesseparately. If any court or relevant authority decides that any of them areunlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you doanything you are required to do under these Cash Terms, or if we delay intaking steps against you in respect of your breaking these Cash Terms, thatwill not mean that you do not have to do those things and it will not preventus taking steps against you at a later date.
You may not transfer, assign or deal in any othermanner with any or all of your rights and obligations under these Cash Termswithout our prior written consent. We reserve the right to transfer, assign ornovate these Cash Terms without your consent. This does not affect your rightto close your Cash Account.
This Privacy Notice describes how Cash, Inc. and our affiliates (collectively, “CashMe,” “we,” and “us”)collect, use, disclose, transfer, store, retain or otherwise process your information when you (“you,” “your”) download CashMe through a relevant app store and sign up for a CashMe account and other services through the app or online at https://cashme.com (collectively,“Services”).

We use your data to make CashMe’sproducts and services work better for you and for others. This describes whatdata we get about you (which can vary depending on where you live).
We need to collect information about you to provideyou with the Services or the support you request. Specifically, we collect(and/or have collected during at least the 12-month period preceding theeffective date of this Privacy Notice) the categories of personal informationdescribed below. Additionally, you can choose to voluntarily provideinformation to us.
Information You Provide toAccess our Services
We use data you put into oursystems when you use CashMe, like financial information, information thatidentifies who you are, transaction information, and any other data you giveus.
We collect information you provide when you applyor sign up for a CashMe account, go through our identity or accountverification process, authenticate into your account, communicate with us,answer our surveys, participate in contests or promotions offered by us or ourpartners, or otherwise use our Services.
We collect the following categories of informationabout you when you use our Services, including:
o Identification Information, such as: Your name, email address, zip or postalcode, phone number, CashID, signature, and authentication credentials (forexample, information you use to log in to your Cash account), includingInternet Protocol (“IP”) address.
o Additional Identification Information forVerified Users, such as: Your full mailingaddress; date of birth; government-issued identification, including SocialSecurity number, passport, or driver’s license; and photograph, facial scan andbiometrics extracted from such image if you choose to share such information inorder to send and receive larger payment amounts or purchase Bitcoin.
o Financial Information, such as: Bank account and payment card numbersyou add to your CashMe account, as well as your CashMe Card number if you haveone.
o Contacts Information. In order to provide you with the Service, wewill also need to collect information from you about the intended recipient ofthe payment you request us to make. We will therefore ask you to providecontact details of your intended recipient. You can do this by manuallyentering a phone number or email address into the CashMe. You can also chooseto let us access your phone contacts information, as described below(under Information You Provide to Enhance Your Experience).
o Transaction Information. When you use our Services to make, accept, orrequest payments, we collect information such as: when and where thetransactions occur, the names of the transacting parties, a description of thetransactions, the payment or transfer amounts, and the devices and paymentmethods used to complete the transactions.
InformationYou Provide to Enhance Your Experience
We also use data you give us tomake your experience with CashMe better, like contacts you choose to upload tomake it easier for you to exchange money with them.
You can choose to provide us with additionalinformation to improve your user experience when using our Services:
o Contacts Information. You can choose to let us access and uploadyour phone contacts information to make it easier for you to find the peopleyou want to send money to, to help you invite your friends to CashMe, foraccount and identity verification and fraud prevention purposes, to reduce therisk you will send payments to the wrong person, or to provide otherpersonalized services. You can update your settings to stop sharing your phonecontacts with us at any time, although we will always need a recipient’s phoneor email address to send money to them as requested by you.
o Other Information You Provide. We collect information that you voluntarilyprovide to us, including your photograph, if you choose to upload a picture tothe Services; survey responses; participation in contests, or other prospectivemarketing forms or devices; suggestions for improvements; referrals; or anyother actions you perform on the Services.
Information We Collect From YourUse of our Services
We also get data from thedevices you use when you interact with our systems, like your location andinformation about the device you’re using. We need this data to do things likehelp protect your account from hackers, combat fraud, check if payments arebeing made or received legally and by you, and making our products and servicesbetter for you and others.
We collect information about you and the devicesyou use to access the Services, such as your computer, mobile phone, or tablet.The information that we collect includes:
o Geolocation Information. The location of your device, including yourIP address, device language, and location of your network provider. This mayinclude precise geolocation information. For more information and to learn howto disable collection of precise geolocation information from your mobiledevice, please see below.
o Device Information. Information about your device, including yourhardware model, operating system and version, device name, unique deviceidentifier, mobile network information, and information about the device’sinteraction with our Services. If you use an iOS device, we also automaticallydetect if you have downloaded Chrome, so we can ask you which browser youprefer to use to open links from your CashMe.
o Internet or other electronic network activityinformation. Information about how youuse and interact with our Services, including your access time, “log-in” and“log-out” information, browser type and language, country and language settingon your device, IP address, the domain name of your internet service provider,other attributes about your browser, mobile device and operating system, anyspecific page you visit on our platform, content you view, features you use,the date and time of your use of the Services, your search terms, and thewebsite you visited before you visited or used the Services.
o Inferences drawnfrom any of the information we collect to create a profile about you that mayreflect, for example, your preferences, characteristics, and behavior,including for account security purposes or to enhance our Services to you.
SOURCES OFINFORMATION WE COLLECT ABOUT YOU
We also need to check that youare using our services legally, that you are eligible for the services you wantto use, and we protect your data and our services from fraudsters who may putyou and your money at risk. To do this, we may collect data about you fromcompanies that help us verify your identity, do a credit check, prevent fraudor assess risk.
We collect (and/or have collected during at leastthe 12-month period preceding the effective date of this Privacy Notice)information about you from the following categories of sources:
o You directly, when you submitinformation to us or allow us to access information

o Identity Verification. Information from third-party verificationservices (e.g., identity verification agencies and companies which providethird party analytics (see “Third-Party Analytics” below)), and publiclyavailable sources. In some circumstances, where lawful, this information caninclude your government-issued identification number.
o Credit, Compliance, and Fraud. Information about you from third parties forany credit investigation, credit eligibility, identity or account verificationprocess, fraud detection process, or collection procedure, or as may otherwisebe required by applicable law. This includes, without limitation, the receiptand exchange of account or credit-related information with any credit reportingagency or credit bureau, where lawful, and any person or corporation with whomyou have had, currently have, or may have a financial relationship, includingwithout limitation past, present, and future places of employment, financialinstitutions, and personal reporting agencies.
HOW WE USEYOUR INFORMATION
We use your data to do thingslike make sure the products you are using work, help you log in to youraccount, verify who you are, secure your data, fight fraud, follow the law,enforce our agreements, figure out what new products we can build, and marketand tailor our products to you.
We may collect, use and share (or have collected,used or shared during at least the 12-month period preceding the effective dateof this Privacy Notice), information about you for the following reasons:

o Conducting investigations,complying with and enforcing any applicable laws, regulations, legalrequirements, and industry standards, and responding to lawful requests forinformation from the government or to valid legal process;
o Contacting you to resolvedisputes, collect fees and help you with our Services;
o Debugging to identify and fixerrors that impair how our Services function;
o Making sure you follow our Termsof Service or other applicable agreements or policies;

If we send you marketing emails, each email willhave instructions on how you can “opt out” of getting future marketing from us.

o For any other reason we may tellyou about from time to time, with your consent.
WHEN ANDWITH WHOM WE SHARE YOUR INFORMATION
We share your information withothers in the circumstances described in this section. For example, with otherpeople with whom you interact when you use our services; within our family ofcompanies who may offer services that we think could be useful to you; withservice providers who help us run our services; or if we need to share yourinformation to comply with the law.
We may share the information described in the“Information We Collect About You” section with the following categories ofservice providers and third parties:
With Other Users of our Services
o With other users of ourServices. For example, we may share information with the person(s) with whomyou transact when you make or accept a payment or money transfer using ourServices. This helps them know they’re getting money from you (or that you requesteda payment from them). We may also make certain information available to other CashMecustomers to help them know they’re making a payment to the right person, suchas when you joined CashMe and whether you appear in their contacts, and thenumber of people in their contacts who have also transacted with you. We mayalso make certain information available to person(s) with whom you choose tocommunicate using our Services to help them know they are communicating withthe right person, such as your name, CashID, and prior transaction history withsuch person. If you choose, we may also allow you to share additionalinformation about you and your use of our Services with other CashMe customers.
With our Affiliates and GroupCompanies
o With our group companies andcorporate affiliates, for the reasons outlined above. For example, we may shareyour information internally to provide you with enhanced services from CashMeand our other company products you use, to understand how you engage with ourcompany products to help make our Services better for you and for everyone, andto help us build Services tailored to your preferences.
With our Service Providers
o With service providers who helpus provide, maintain, and improve our Services (e.g., vendors who help us withfraud prevention, identity verification, and fee collection services), as wellas financial institutions, payment networks, payment card associations, creditbureaus, carrying brokers, and other entities in connection with your payment,money transfer process, investing activity, or otherwise to help us provide theServices;
With Advertising Partners
